Ebay Terms & Conditions

The following terms govern your use of our Ebay storefront and your relationship with Designer Habitat ltd. Please read them carefully as they affect your rights and liabilities under law.

If you do not agree to these Terms, please do not access nor use the Website. If you have any queries regarding these Terms then please contact us by phone or by email.

1. Agreement

By making a purchase from us you are agreeing to abide by, and are governed by these Terms.

2. Amendments

We reserve the right to:

· Update these Terms from time to time

- Any changes will be notified to you by an announcement on the website

- It is then your responsibility to read these changes. If you do not wish to accept the new Terms please do not continue to use the website.

- If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms; and

· Modify or withdraw the Ebay storefront and the products listed within, either temporarily or permanently without notice.

- We shall not be liable to you for any changes to the Ebay storefront or removal of its contents.

3. Registration

You warrant that:

· the personal information which you are required to provide when you register is true, accurate, current and complete in all respects; and

· you are not impersonating any other person or entity

4. Orders

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail as quickly as possible (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order and receive a full refund.

Any orders placed by you will be treated as an offer to purchase the goods from us and we have the right to reject such offers at any time.

You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we either debit your credit/debit card/ PayPal account, or dispatch the goods to you, whichever is the later.

We will do everything that is reasonable in our power, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Website.

The products sold on the Website are not for re-sale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.

You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the delivery address which you specified.

5. Cancellation Rights

Where you have purchased the goods or services as a consumer (i.e. for private use as opposed to business use), please note that you are entitled to cancel any contract completed with us within 7 days from the day after receipt of the goods or services.

If you do cancel a contract pursuant to this clause 4, then:

· you must notify us by contacting us

· you must retain possession of the goods or services and ensure that the goods or services are kept in the same condition as they were when they were delivered until such time as the goods or services are either collected by us or delivered back to us by you;

· we will notify you of when we wish to collect the goods or services. The goods and services will be collected by us within 28 days of our receiving your cancellation notice and we will charge the cost of collecting the goods or services, and will deduct this from any sum owed by us to you. Alternatively, you can return the goods or services to us by contacting a customer service operator on 08454598104 (between the hours of 9.00am to 5.00pm) who will be able to provide you with address details;

· We will refund any monies you have paid to us within 30 days of receipt of your cancellation notice.

Please note we are unable to cancel any orders that have already been shipped.

11. Price and Payment

All prices shown are inclusive of VAT (only where applicable - see below) at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice.

If your delivery address is within the United Kingdom, no additional taxes will be charged to you. If your delivery address is outside of the United Kingdom you may be subject to import duties and taxes (including VAT), which are levied once a delivery reaches your destination country. Any such additional charges must be borne by you, and is your responsibility to pay. You should note that customs policies and practices vary widely from country to country. We recommend that you contact your local customs office for more information.

Please note that when shipping goods from outside the United Kingdom, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of the United Kingdom, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered. We cannot be held responsible for packaging defects or tarnishes incurred during such inspections.

Payment can be made by any major credit or debit card or via your PayPal account. Payment will be debited and cleared from your account before the dispatch of your good or provision of the service to you.

In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order in accordance with clause 4, we are not required to sell the goods to you at the price shown. We always endeavour to ensure that the prices of goods shown on our Website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund.

You confirm that the credit, debit card or PayPal account that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us we will not be liable to you for any delay or non-delivery.

You are allowed to use only discount code with each order. We reserve the right to reject or cancel any orders where you add more than one discount code to the basket.

We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value. Please familiarise yourself with these terms and conditions before you place an order as we reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged. If there is any inconsistency between the terms and conditions upon which the discount codes were issued and these terms and conditions, the discount code terms and conditions prevail.

15. Severance

If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.

16. Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

17. Entire Agreement

These Terms form the entire basis of any agreement reached between you and us.

18. Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

19. Returns

Thank you for your purchase, and we hope that you are happy with your product.

If you are unhappy with anything that you receive from us please contact a member of our customer service team as soon as possible, and we will endeavour to resolve any issues you are having as quickly as possible. All our emails are responded to within 24 hours (excl. weekends and bank holidays), and our phone lines are manned Monday – Friday between 9 and 5.

If you wish to cancel your order before your items have shipped then we ask that you contact us immediately by email or phone. We are unfortunately unable to cancel orders which have already shipped. If you change your mind after the item has shipped please follow the returns process outlined below.

If you no longer require an item that you have received from us, please contact us within 7 days of receiving it to arrange the return. Items weighing less than 1.5kg must be returned via a royal mail 2nd class service. Please note we are only able to refund return postage in the case of damaged, faulty, or wrongly supplied goods. Postage refunds are not granted for items returned at customer’s choice. A copy of the postage receipt (scanned or a photograph) must also be provided via email before return postage can be issued. Return postage costs for items returned by recorded delivery, special delivery or any other courier method will not be refunded.

For larger products we can arrange for our courier to collect the parcel from any mainland UK non-highland address of your choosing. The fee charged by the courier for this service is £6.99. Alternatively you can return the item by your own means for a full refund. The customer must arrange the safe return of the item.

You must return the goods in their original packaging and in the same condition as they were received. A returns form must be included with all returns in order for refunds to be processed.

Please note that International buyers and those who live in remote areas of the highlands and UK off mainland locations (including Northern Ireland) are responsible for all return postage costs.

In the unlikely event that an item is damaged on arrival, or has a fault on use please advise us as immediately and we will endeavour to get a replacement to you as quickly as possible. For any damaged, faulty or incomplete items, you will be asked to provide photographs showing the damage, the parts received, or to demonstrate the fault (where applicable) so that these can be assessed and claims rose against suppliers or couriers for the lost revenue.

We also offer an exchange service to customers who would like to exchange a product they purchased for any other in our range. Using this service the courier will arrive with the new product, and at the same time take away the old one. This is charged at £9.99 +/- any difference in item cost.
