RoughTrax Ltd, Terms and Conditions regarding the sale of Toyota Hilux 4x4 parts in the UK.
Ebay Terms & Conditions
All Payments must be received within 7 days. Contact is required
within 24 hours of the end of auction to confirm payment method. We are fully
equipped to take credit and debit card payment over the phone.
UK landline and/or mobile number must be supplied before shipping. All deliveries
are made via Courier and are on a 1-2 day service on orders placed before 3pm
unless otherwise arranged by the purchaser. Smaller items are sent via Royal
Mail 1st Class Recorded.
International Bids are welcome but international bidders must arrange shipping
or collection of the items won. Please email us before bidding to confirm.
Collection can be arranged; we are open from 8.30am-5.30pm Monday-Friday. Please
call before collection to ensure we have your item ready for collection.
We do package all items as best we can but please ensure you always check your
goods for damage before signing in good order. If your item/s are damaged please
sign as damaged or refuse delivery and contact us immediately.

Please Note. All our Parts and Accessories are to fit 4 Wheel
Drive (4WD) Hilux Pickups & Hilux Surfs ONLY. Any part
ordered for a 2 Wheel Drive (2WD) is solely down to the customer and we will
NOT accept a returns.
1. Our Contract
These Terms and Conditions govern the supply of goods sold by RoughTrax Ltd, the seller. RoughTrax Ltd, Brookleaze, Stockwood Vale, Keynsham, Bristol, BS31 2AL, 0117 9869065 VAT No. 762787387. Customers purchasing any product from RoughTrax in any way agrees to these Terms and conditions without prejudice. 2. Price Information
All prices are correct at time of display online and Exclude
VAT on our website and Include VAT on Ebay. Special offers and promotions advertised
in the press or other media may be excluded unless specifically advertised as
available online. In the unlikely event of an administrative error resulting
in an incorrect price being displayed, we reserve the right to correct the price.
In these circumstances, we will notify you by email and ask you to confirm by
return email that you wish to proceed with your order.
3. Delivery of Goods We can deliver to addresses within the United Kingdom although for deliveries to non-mainland UK addresses and certain remote locations e.g. Scottish Highlands, Isle of Man, Northern and Southern Ireland, Scottish Isles and the Channels Islands there may be an additional delivery charge which will be advised and a slightly longer delivery lead time. Invoices will be attached to the delivered parcels unless otherwise instructed. Please retain ALL paper work for any future warranties or queries as details of your purchase will need to be provided. Goods can be delivered either to your home address, to an alternative address or to your work. Your order will be delivered by a national parcel carrier and can arrive between 8.30am and 5.30pm on a 1-2 Day service on orders placed before 3.00pm subject to stock. Please note orders placed on a Friday will be delivered on a Monday unless a specific time has been requested. Please note we rely on a national courier to deliver our goods on a 1-2 Day basis, should the parcel not arrive with in 1-2 Days RoughTrax will not be held responsible for a late delivery, however we will endeavor to do our up most to ensure the courier delivers ASAP, No claim can be made against RoughTrax Ltd for a late or mis-routed deliveries. A surcharge will be made for a Saturday or Timed delivery upon request to RoughTrax Ltd via telephone or email. A signature will be required for all goods. In order to assist us with claims for damage or shortages please inspect your parcel(s) carefully before the driver leaves and note on the carrier paperwork if there are any signs of damage or shortages. If you are out when the parcel carrier arrives the driver will leave a card with the contact number for you to call to arrange a suitable time for re-delivery or for you to collect the goods from the local depot. Please note our couriers will try to deliver on 2 occasions and will leave a card if not in, RoughTrax Ltd will also try to contact our customer on the telephone numbers given, should RoughTrax Ltd or the courier receive no communication then the parcel will be returned to RoughTrax Ltd. RoughTrax Ltd can not be held responsible as we have tried to deliver the goods. The goods can be re-delivered, however another carriage charge will be made for this extra service. For delivery of goods outside the United Kingdom please email us with your details and we will contact via email within 24 hours. If any goods are required to be replaced, for what ever reason, RoughTrax Ltd will only deliver to the original address the goods were shipped to. Any goods shipped out of the U.K is up to the customer and not covered by RoughTrax Ltd, warranty of any goods will only be applied to the UK and Channel isles. Damaged goods upon delivery can only be replaced providing the customer signs for the goods as being damaged, a claim can then be made against the couriers for the replacement. If the customer signs for the goods as received in "Good Order" (or alike), and the goods upon opening are found to be damaged then NO claim can be made against RoughTrax as they have been signed for as received in good order. All goods can simply be signed for as "Damaged" if you or the couriers do not have time or the facilities to check the goods, this is acceptable with RoughTrax Ltd and our couriers and will cover you as the customer. In short please check the way you sign for the goods, this also includes the number of parcels being signed for. Goods that come to a carriage rate of £4.00+ VAT during checkout will be sent via Royal Mail Recorded Delivery to keep the cost down as per customer requests to RoughTrax Ltd. This means that the TNT tracking service on the confirmation email will not be in force, customers can request via telephone/email the Royal Mail reordered tracking number if required. 4. Availability While we endeavor to hold sufficient stock to meet our orders, if we have insufficient stock to supply or deliver the goods ordered we might arrange for the goods to be dispatched direct from the manufacturers. If the goods are not expected to be available for delivery within 30 days we will contact you to advise an anticipated delivery date. 5. Payment
We accept payment by Paypal & most major credit or debit
cards. Payment will be debited to your account only when stock is available
unless otherwise arranged. Payment for the whole value of the goods you ordered
must be debited before goods will be dispatched. All credit/debit cardholders
are subject to validation checks and authorization by the card issuer.
If the card issuer refuses to authorize payment we will endeavor to contact you by either telephone or email to verify certain details however this may result in a delay or non-delivery of you order until contact has been made. In addition, in the interests of preventing fraudulent use of credit and charge cards, RoughTrax Ltd will validate the names and addresses supplied during the order process. We may need to contact you by email, telephone or letter to verify details before are able to dispatch your order. 6. Unwanted/ In-correctly ordered Goods If you decide that you do not want any item which we have delivered then, provided that it is returned to us in its original and unused condition (including its original packaging) and dispatched within 14 days of delivery unless otherwise agreed prior with RoughTrax Ltd, we will exchange it or offer a refund for the product, NO carriage will be refunded and a re-stock charge of 10% minimum will be applied subject to RoughTrax Ltd discretion. This also applies to any goods supplied correctly by RoughTrax as ordered, however, if ordered in-correctly by the customer, the customer will be entitled to a product refund only, no carriage will be refunded and the customer is held responsibly for the return of the goods to RoughTrax unless prior arrangements are made with RoughTrax. Refunds will only be given once the goods have been returned in good order and original packaging. This does not apply to goods specially ordered such as colour coded items or a specifically ordered Toyota Hilux part that has been requested. Any goods listed as "stocked to order" will also NOT be eligible for any refunds, even if wanting to be returned before the 14 days, "Stocked to order" means specifically ordered for your purchase and therefore non-returnable. Please note our couriers charge a minimum collection fee of £15.00+ VAT for a return consignment subject to goods, this would be charged to the customer's card upon agreement. The customer can arrange his or her own return by alternative means. We will refund your payment within thirty days from the date of cancellation. This guarantee is in addition to and does not affect your statutory rights. 6a. Returns and Exchange Goods
Goods will only be accepted for return provided that it is returned to us in its original and unused condition (including its original packaging) and dispatched within 14 days of delivery unless otherwise agreed prior with RoughTrax Ltd. For customers who wish to return any goods then here is a good courier company that we use called Interparcel where you can view the range of services and prices to suit you. Interparcel offers you very low cost courier rates using some of the biggest carriers in the world. UK & International courier services. Exchange goods will need to be returned to RoughTrax Ltd
by the customer unless otherwise agreed, please note that any goods sold as
"Exchange Goods" will carry a MINIMUM (subject to product being
exchanged) of £50.00 + vat chargeable to the customer, for any non returned
goods, this is to allow us to be able to provide the service that one customer
has received ready for the next.
6b. Refunds on returned Exchange
goods
A Refund (if applied to a product) will only be issued subject to the following conditions; i) The goods in question being returned to the RoughTrax address by the customers own means (see Carriage FAQ's) ii) The returned exchange customers unit is fit to be re-conditioned ready for the next customer (afterall, this is how we start the exchange service chain) iii) RoughTrax and its suppliers will strip and assess the returned unit and advise our customers if the return is not fit for service. Only RoughTrax will decide the serviceability of the return iiii) RoughTrax maintains all rights to withhold the refunded amount should the returned unit not fall within our criteria.
7. Defective Goods
If you purchase a product from us that are found to be faulty we will supply a replacement, arrange for a repair or give you a refund of the purchase price. To arrange the return of the defective goods please contact our office on 0117 9869065 or email info@roughtrax4x4.com our parcel carrier will arrange to collect the goods from you. Upon receipt of the product we will examine it or we may have to return it to the manufacturer for examination. We aim to dispatch a replacement product, arrange a repair or refund your money within 14 days. Miss-use or the incorrect fitting of parts by customers will render such warranty/guarantee null and void. The customer must provide adequate paper work details received with the initial order, such as invoive number or Customer number in order for us to proceed with any claims. It is the responsibilty of the customer not RoughTrax to source and provide these details prior to any claims. 8. Warranties and Liability Subject to the condition set out below the Seller warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date of their initial use or 12 months from delivery, whichever is the first to expire. The Seller shall NOT be liable for any Labour or associated claims should a product fail, warranty will however apply to any part or parts purchased by the buyer within the warranty period to include carriage to replace the original purchased goods. the Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller’s instructions (whether oral or in writing), misuse or alteration or repair of the Goods without the Seller’s approval.the Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller’s instructions (whether oral or in writing), misuse or alteration or repair of the Goods without the Seller’s approval. Goods must be checked for suitability and tolerance prior to fitting or preparation. No responsibility whatsoever is accepted for the fitment of incorrect parts. The responsibility is clearly with the purchaser/fitter to ensure the parts supplied are correct for the particular job. The Company is not responsible for any damage or consequential losses or cost resulting from the fitment of parts supplied. The website shall always endeavour to provide the correct information, however, on occasion the images may not always depict the actual product and RoughTrax reserve all rights to change a product for another that is fit for purpose.Subject as expressly provided in these Conditions, and except where the Goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, condition or other terms implied by statute or common law are excluded to the fullest extent permitted by law. Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The purchaser also accepts that it is reasonable to inform the seller of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow the seller to remedy the defect, failure or interruption. Parts modified or adapted by the purchaser shall no longer be warranted by the manufacturer nor shall the Company be liable for any failures resulting subsequent to modification as a result of such modification.Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet specification is notified to the Seller in accordance with these Conditions, the Seller shall be entitled to replace the Goods (or the part in question) free of charge or, at the Seller’s sole discretion, refund to the Buyer the price of the Goods (or a proportionate part of the price), but the Seller shall have no liability to the Buyer. Except in respect of death or personal injury caused by the Seller’s negligence, the Seller shall not be liable to the Buyer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, and the entire liability of the Seller under or in connection with the Contract shall not exceed the price of the Goods, except as expressly provided in these Conditions. The Seller shall not be liable to the Buyer or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Seller’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond the Seller’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond the Seller’s reasonable control
The customer must provide adequate paper work details received with the initial
order, such as invoive number or Customer number in order for us to proceed
with any claims. It is the responsibilty of the customer not RoughTrax to source
and provide these details prior to any claims.
8. Goods ordered/Supplied incorrect
In the event that goods have been ordered incorrect or supplied
incorrect, it is up to the customer to check the goods prior to any fitment.
In the event that the goods have been attempted to be fitted and damaged in
doing so, the customer shall be held liable for those goods and incur all
costs. In the event that a panel has been painted prior to checking the fitment
first and proves to be wrong, RoughTrax Ltd can not be held responsible for
any costs such as labor or paint. It is up to the customer to check their
fitment of the goods before altering any of the goods supplied.
The buyer must check all goods supplied by RoughTrax, the
seller, and advise within a 14 day period as to any defects/ wrongly supplied
goods.
RoughTrax will only accept a return product that has been
wrongly supplied/delivered after being advised within a 14 day period, after
which the customer shall retain all goods unless otherwise prior arrangement
are made with RoughTrax to the contrary
Wheels: 4x4 fitment only all 6 stud
Wheels are warranted for a period of one year against defective
materials and workmanship. This warranty does not cover the following: Damage
Alloy, Chrome or Lacquerer surfaces due to:
a. Normal On-road and Off-road wear and tear including stone
chips etc.
b. Salted Roads in winter causing salt corrosion.
c. Use of abrasive chemical cleaners
Wheels should be cleaned using mild soap and water solution,
chrome caps are not covered under warranty due to nature of our British climate.
9 . Law Applicable
These conditions and all contracts shall be governed by and
construed in accordance with English Law.
