Definitions
In these ‘terms and conditions’, the followings expressions shall have the following meanings:
“We/Our/Us” means StationeryGeeks which is a trading name of BSD Ltd.
“You/Your/Yours” means an individual, business, or corporate body (which expression shall, where the context so admits, include its successors and assigns) which purchases “Goods or “Services” from “Us”.
“Site” means “Our” eBay shop found at http://stores.ebay.co.uk/StationeryGeeks
“Content” means the information, designs and other material available on the “Site”.
“Goods, Products or Services” means the “Goods”, “Products”, or “Services” provided by “Us” to “You” the ‘Customer’
Any reference in these conditions to a statute or a provision of a statute shall be construed as a reference to that statute or provision as amended, re-enacted or extended at the relevant time.
The headings in these conditions are for ease of reference only, and shall not affect the interpretation.
StationeryGeeks comply with current ‘terms and conditions’ which are set down within the Consumer Protection (Distance Selling) Regulations 2000 (see below).
Disclaimer of Liability
The content of our “Site” is for “Your” personal use only. “You” agree and confirm that under no circumstances shall you copy, distribute, transmit, reproduce, publish, commercially exploit or create derivative works from the content. In no event shall “We” be liable for special, indirect, exemplary, or consequential damages or any damages whatsoever, including but not limited to, loss of use, data, or profits, without regard to the form of any action, including but not limited to contract, negligence, or other tortuous actions, all arising out of or in connection with the use, copying, or display of the “Contents” of this “Site”. In an effort to provide “Our” “customers” with the most current information, “We” will, from time to time, make changes in the “Contents” and in the products or services described on this “Site”.
“You” acknowledge and confirm that the Site may from time to time contain certain errors which may result in temporary unavailability of the “Site”. In addition you acknowledge that the running of the “Site” may be affected by external conditions and performances, including but without limitation telecommunication links between our systems and networks. We accept no liability whatsoever for any losses, costs, claims, liabilities, demands or expenses of whatever nature suffered or incurred by “You” as a result of the availability of our Site.
Payments
Please note that it is “Your” responsibility to pay via one of the methods below with 4 days of the end of auction or buy it now methods. “We” accept the following payment methods:
- PayPal - Note that “We” will not accept payments without a confirmed address as per Paypal's Terms & Conditions, Section 3-C-1. “We” are also required by these terms and conditions to send goods to this confirmed address only. Any payment showing an unconfirmed address will be returned.
- Paypal payments on collection only items - If you pay by via Paypal and collect the “Good” “You” must bring with you a printout of the email you receive from Paypal showing this payment (which “We” will keep) together with ID in the name shown on the Paypal email. No goods will be released without this information.
- Credit Card or Debit Card – “Goods” will not be sent until “We” have a verifiable address on record. If your details supplied are not verified, “You” will be notified via e-mail within 48hr of supplying the information.
- Cheques – Must be made payable to BSD Ltd.
- BACS – Email “Us” for payment details.
- Cash – Must be sent recorded delivery.
- Postal Orders – Must be made payable to A Wragg)
Delivery
All goods are sent either via Royal Mail with Proof of Posting or Recorded Delivery or via Courier which includes full traceability and limited insurance. “We” will only ship to mainland UK which excludes certain posts codes in the Highland, Islands, and Northern Ireland.
“Goods will be despatched within 48 hours of cleared funds, subject to the conditions listed in the payment section above.
We accept no responsibility for goods delayed due to the services of Royal Mail or Courier.
All goods we sell are covered by the Distance Selling Act (see below)
Delivery dates are given in good faith. “We” accept no liability whatsoever for any losses, costs, claims, liabilities, demands or expenses suffered or incurred by you arising out of or in connection with our failure to meet such delivery dates. If you have not received your order, it is your responsibility to notify us as soon as practicably possible. “We” cannot be held responsible for delivery delays caused by any third parties. If for any reason, your order is delayed we will always inform you immediately.
Returns, Refunds & Cancellations
When returning any “Goods”, “You” should contact “Us” first, and advise of the reason for return. Once “We” have been notified “We” will issue “You” with a returns number, and necessary arrangements for return will be made. No returns will be accepted without a returns number.
All “Goods” must be returned to “Us” with their original packaging and must be in “saleable” condition (i.e. packaging not torn, damaged or defaced). “You” must take all necessary precautions to protect the “Goods” ensuring the “Goods” arrive back to “Us” without damage. Except were “Goods” are incorrect you are responsible for the cost of return. For “Your” protection, “You” must ensure that “You” are using an insured, traceable service to return the “Goods”, as “We” will not be responsible for loss or damage during transit, that is evident, and reported to Royal Mail or the Courier, when the package arrives. We will refund the full purchase price on undamaged items as specified above.
If “Goods” are returned to “Us” because “You” failed to collect the parcel after receiving a card from Royal Mail or the Courier, the full cost of postage or carriage will be payable again. If “You” choose not to pay postage or carriage costs again “We” will issue a refund less the original postage or carriage charge. Some couriers reserve the right to charge for holding the “Goods” or attempting to redeliver after a card has been left. “You” will be responsible for these charges.
”We” do not accept responsibility for the failing of a delivery, and to this matter will not consider any losses incurred as a result. “We” will however pursue a claim with Royal Mail or the Courier for any delivery that does not arrive.
When signing for the package, “You” will be signing to say that “You” have received it in good condition. It is vital that “You” actually examine the outside of the carton before “You” sign – noting Damaged “Goods” or similar on the relevant paperwork if necessary. “You” should keep all packaging until “You” are satisfied that the item inside is undamaged. Any claim for transit damage may depend on the packaging being available for inspection. If the claim is allowed, the courier will normally pay for collection.
All incorrect/ faulty or damaged “Goods” must be reported to us within 24 hours of receipt. If incorrect/faulty “Goods” have been supplied in error “We” will be responsible for the replacement.
We will gladly mutually cancel any purchase at anytime, please email us and request it, if however the order has been processed and despatched this will no longer be possible.
Distance Selling Regulations 2000
These regulations apply to sales to private individuals (rather than business customers) who purchase by means of one of eBay’s ‘Buy it Now’ formats and excluding ‘Auction’ items, and specify that you have a ‘cooling-off’ period of 7 working days from receipt of the goods during which time you may notify us in writing, by email, fax or post, of your wish to cancel. Any goods returned to “Us” under this provision must come back to us within 14 days. This applies to items which “We” have dispatched to you only - if you collect then Distance Selling regulations do not apply.
”You” have a ‘duty of care’ for the goods and they must be returned to us in a brand new “saleable” condition. This means they must be in the original packaging, and the packaging not torn, damaged etc, with all original inserts, instructions, etc. Once “You” have used, assembled, inserted, mounted the item, then you will be deemed to have accepted it and this option will no longer apply.
Prices & Retention of Title
Full payment of cleared funds must be made prior to any “Goods” being despatched. Ownership of the “Goods” and “Services” shall remain at all times vested in “Us” until full payment of cleared funds. “We” reserve the right to change all item and delivery prices without formal notice. All prices quoted are inclusive of VAT.
Warranties
All items that are covered by a manufacturers warranty will be stated in the listing or on the packaging, or insert sheets. The warranty will be between “You” and the ‘manufacturer’ and “We” will not be held responsible for any faults or failure of goods that are not notified upon receipt. Items without a specific warranty are sold as being in working order, unless otherwise specified in the listing, and we will only refund or replace any item which fails within a maximum of 7 working days from delivery.
Patents
The “Customer” shall indemnify “Us” against all actions, costs (including the cost of defending any legal proceedings), claims, proceedings, accounts and damages in respect of any infringement or alleged infringement of any patent, registered design, unregistered design, design right, copyright, trademark or other industrial or intellectual property rights resulting from compliance by “Us” with the “customers” instructions, whether express or implied.
Indemnity
The “Customer” agrees upon demand to indemnify “Us” against all losses, damages, injury, costs and expenses of whatever nature suffered by “Us” to the extent that the same are caused by or related to: 11.1 designs, drawings or specifications given to “Us” by the “Customer” in respect of the goods; defective materials or products supplied by the “Customer” to “Us” and incorporated by “Us” in the goods; or the improper incorporation, assembly, use, processing, storage or handling of goods by the “Customer”.
Health and Safety
The “Customer” agrees to pay due regard to any information or any revised information whenever supplied by “Us” (and is deemed to have been given adequate information and to have read and understood it) relating to the use for which the goods are designed or have been tested or concerning conditions necessary to ensure that they will be safe and without risk to health at all times when they are being set, used, cleaned or maintained by any person at work or when they are being dismantled or disposed of, and the “Customer” undertakes to take such steps as may be specified by the above information to ensure that as far as reasonably practicable the goods will be safe and without risk to health at all times as mentioned above. For these purposes the “Customer” is deemed to have been given a reasonable opportunity to test and examine the goods before delivery.
Notices
All demands notices and other communications shall be in writing and addressed to “Us” at the address shown on invoices delivered by it and to the “Customer” at the address given by it for delivery of invoices (or as subsequently notified by one to the other in writing) and shall be deemed served if delivered, at the time of delivery; if posted, 48 hours after being posted by first class post, e-mail and if sent by facsimile transmission, at the time of transmission.
Invalidity
The invalidity, illegality or unenforceability of any provision of these conditions should not affect the other conditions.
Laws and Jurisdiction
The Conditions shall be governed by and construed in accordance with English law and the parties hereby submit to the non-exclusive jurisdiction of the English Courts.
