TERMS AND CONDITIONS OF SALE
Please read the following terms and conditions prior to ordering or purchasing from this website. By purchasing any item you are agreeing and will be bound to eBay's Policies and our Terms & Conditions as set out below, eBay's definition of a purchase is by "Committing to buy" an item either by placing a bid on and winning an auction and/or buying an item from a Buy it Now listing.
1 - PAYMENT
1.1 - Shop Items
Complete payment through Paypal is preferred for all stock items. We accept payment via any of the methods below.
Cleared payment must be received in full before items are released for despatch.
1.2 - Conservatories
and Windows
With higher value items such as conservatories, you may;

Pay the full amount upfront by any of the accepted payment methods below, or
-
Enter into a payment agreement as set out below (this is a binding contract and failure to comply with contract terms
and/or failure to make payments will result in cancellation of order and a non refund of deposits paid
and/or further action to recover outstanding sums.)

**Payment
must be received in full before items are released for despatch.
With conservatory and window orders we can only accept a personal cheque
as a deposit, if you wish to pay the full amount or final balance by way
of personal cheque, the conservatory will not be released for delivery
until payment has cleared.
2 - DELIVERY
2.1 - Small items*: will be sent via Royal Mail 1st class
(1-2 days, usually next day if ordered by 4pm), 2nd class (3-5 days)
or Standard Parcels (3-5 days).
All items will be sent well packaged while in the hands of our postal service. Charges vary on size and weight.
2.2 - Medium items*:
such as electrical products, heavy or bulky items etc, will be sent via courier service.
Our main couriers in the south west are DHL & Parcelforce. Other services may be used for different areas in the UK. Charges are standard on weight
and location.
2.3 - Fair Postage Policy: as a company
we operate a Fair Postage Policy, therefore we do not charge handling fees, only
the packaging costs are added to all Royal Mail and Courier deliveries.
2.4.1 - Large items: Conservatories
and Windows require large transport to fit up to 5 metre lengths depending on size, buyer may arrange collection.

All DIY conservatory roofs are flat packed, doors and
window frames are supplied unglazed to ease transport and installation.

vary depending on location please contact us with your postcode for
further details.

We only deliver to mainland UK. If you live outside the UK
or any UK islands, please contact us and we will try to make arrangements for you.
2.4.2 - When opting for delivery with our own transport you are agreeing and will be bound to the following terms:

All delivery dates quoted are intended as an approximate guide only. We will endeavour to deliver your order on the agreed delivery date and will notify you of any delay expected. If your order is not delivered as arranged, we cannot be responsible for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

The delivery will be made the nearest suitable point for access by the delivery vehicle which will normally be a 7.5 ton box vehicle or larger. If the site is not accessible by our vehicle it is your responsibility to accept the delivery at the nearest available point and to provide onward transport to your site.

You must supply sufficient labour to offload your order and sign the delivery note. If we are unable to deliver your order because no-one is present to receive the delivery we will make arrangements for re-delivery at additional cost. If for any reason we are unable to offload your goods on the agreed delivery date, we reserve the right to charge an additional £150 + vat for their return and offloading at the factory, reloading and redelivery.

We will normally deliver your order in one complete delivery but reserve the right to make part deliveries at our cost.

Risk for the goods will pass to you once your order has been delivered and we cannot be responsible for loss or damage once you have received your order.
* Items are subject to free delivery when ordered with a conservatory and delivery with our own transport.
3 - RETURN POLICY
- All conservatories, door and window frames and
related glazing units are manufactured to your specification and therefore there is no right to cancel the contract with us. Cancellation can only occur as specified in Liability
Clause 5.3.2 below.
- You have the right to cancel stock items ordered from this
website within seven days from delivery and receive a full refund
for the returned item(s). It is your responsibility to ensure that these goods are returned to us in a good and resalable condition complete with the original packaging. If you request us to arrange for their collection, we will deduct the cost of carriage from any refund due to you. Any items that are returned to us damaged will not be refunded and can be returned to you at your cost.
4 - CHANGES TO YOUR ORDER

All conservatories are manufactured to order and production of the components for your order will commence shortly after your order has been confirmed
by you. If you require changes to be made to your order we may make additional charges for any components that have or are in the process of being manufactured and cannot be used elsewhere.

If you require changes to be made to an order for
like-for-like stock items, you may do so at anytime before the item
has been despatched, in the instance the goods have been despatched
you must return the goods to us under Return Clause 3.2 for a
replacement or refund. If the replacement goods requested by you are
of higher value you must pay any difference due before the goods
will be despatched.
5 - LIABILITY

If any goods are received damaged or defective or your order has been delivered incorrectly you must notify us within 48 hours of receiving the goods.

Any goods that have been installed cannot be returned unless faulty.

If you notify a problem to us under this clause, we will, at our option:
1. We will endeavour to supply any shortage or non-delivery 48 hours from notification
2. Refund to you the amount paid by you for the parts in question

We cannot be liable to you for any indirect or consequential loss, damage or expenses however arising out of any problem you notify to us under this condition, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the specific parts in question under clause ii) above.

With all products that are supplied for self-installation it is your responsibility to ensure that they are installed correctly. Whilst we provide information to assist you in installation we cannot be liable to you for any loss or damage arising from information we have provided regarding installation.

Technical advice and assistance is available over the phone or via email. If needed you can request a site visit by one of our engineers, an appointment will be confirmed on receipt of payment of £100.00. If the problem is found to be due to a fault in manufacture, this fee will be refunded in full. However, no refund will be due where the problem has been caused by faulty installation of the product or incorrect information provided to us by you when your order was placed.

Although you are legally bound to the terms and conditions set out above, they do not in any way limit your statutory rights.
6 - WARRANTY

All conservatories supplied by us are warranted as follows:

Conservatory roof & frames – 10 years

Profile colour fastness – 10 years

Locks and fittings – 5 year
-
This warranty is not transferable and is provided on the basis that the goods have been correctly installed and maintained in accordance with our instructions.
This warranty does not affect your statutory rights.

All electrical goods carry a manufacturers guarantee, and are subject to the manufacturers terms.

Excluded from warranty is any defect in the goods arising from fair wear and tear, willful damage, accident, negligence, faulty installation by you or any third party, or any alteration or repair carried out without our approval.

Should any goods supplied by us to you develop a defect under warranty you should notify us in writing as soon as possible.
-
Where we replace any item under warranty we reserve the right to arrange (at our cost) for the return of the original item.
7 - DATA PROTECTION
-
We will take all reasonable precautions to keep your details and the details of your order and payment secure. None of your sensitive financial information is held on record.

We agree to use the information you have provided about yourself for the purpose of fulfilling your order only.

Your credit or debit card details are not held by us at any time. All online payments are made through the secure facilities at Paypal and the information you provide for payment is subject to their terms and conditions of use.

We will not sell or give your details to any third parties for marketing purposes.
8 - APPLICABLE LAW

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
9 - EVENTS BEYOND OUR CONTROL
-
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
10 - INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
11 - ENTIRE AGREEMENT
-
These terms and conditions, together with our current eBay listing prices, specifications, delivery details and contact details set out the whole of the agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
12 - THIRD PARTY RIGHTS

Except for our directors, employees or representatives, a person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
