Terms and Conditions of Sale (“Terms”):
These Terms set out the basis on which you purchase goods from us and will form part of any contract of sale between us for these goods. The Terms contain information about your rights and remedies, as well as our obligations and (in some circumstances) limitations of our liability to you. Therefore it is very important that you read and understand these Terms before you sign and submit an order to us. You will be bound by the Terms once a contract comes into existence.
1.1 Please refer to point 1 of the Webstore Terms if you wish to enquire about: goods on the web-store, your order or to make a complaint.
2.1 An order for our goods will be seen by us to be an offer by you to purchase the goods you have ordered subject to these Terms.
2.2 All goods listed for sale are subject to availability. If there is a time where we cannot meet an order you will be refunded for the cost of that order (see Returns and Cancellations). You will also have the option of an alternative order. If this were to happen we would notify you as quickly as reasonably possible.
2.3 All orders are subject to acceptance. We will confirm, via email that we have accepted your order and when your goods will be dispatched. If we cannot accept your order, we will notify you as soon as reasonably possible.
3. Payment and Prices
3.1 We only accept payment through PayPal.
3.2 Payment will normally be taken before we dispatch the goods to you, if we do not take payment before you receive goods then you must pay for them by the time we request.
3.3 If you receive the goods from us and have not paid for them after a calendar month of receiving them then we have the right to give you notice that we are terminating our contract for the sale of the goods to you. In this scenario you must at our discretion either return the goods at cost to you or make them available for collection at the address of delivery. Alternatively, we may charge you interest on the outstanding amount at the rate of 4% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with the overdue amount.
3.4 The price of the items includes VAT.
3.5 The prices are all in UK Pounds Sterling and are subject to change at any time.
3.6 The cost of postage per order is £3.50
3.7 The title of the goods will pass to you once we have received full payment for them (including delivery charges).
3.8 Despite our best efforts it is possible that some of the goods listed on our site may be incorrectly priced. If the correct price should be lower than the price shown, we will reimburse you the difference. If the correct price should be higher, we will normally contact you before dispatching your goods or we reserve the right to reject your order and notify you that we have done so.
3.9 We are under no obligation to provide any goods to you at an incorrect price, even after we have sent you an acceptance email.
4.1 Postage and packaging costs £4.75 per order. So if you order more than one item in a single transaction, you pay only £4.75.
4.2 We aim to dispatch all orders within 5 working days of cleared funds; therefore your item(s) should be delivered within 6-7 working days from placing your order. Whilst we aim to deliver within such non-binding times, we cannot be held to these times, which are approximate only, and we will not be held liable for any delay in delivery of the goods in any way.
4.3 We ship to anywhere in the UK.
4.4 Orders will be dispatched via either Royal Mail or through an approved courier within 5 working days of cleared funds. We require all deliveries via courier to be signed for. Please note: our courier delivers Monday to Friday. If there is no-one available to sign for your parcel they will leave a card with details of when your item(s) will be redelivered or where you need to go to collect your goods.
5. Returns, Cancellation and Risk in the Goods:
5.1 We operate under the Distance Selling Regulations, which means that you have up to 7 working days after you have received your delivery to cancel your order via Peugeot Direct and have the cost of your item (including delivery) returned to you.
5.2 If you would like to return an item within this time period, please send us a message through eBay and we will respond with the return address and an identifying number for you to enclose with the returned product. Please be aware that you are responsible for the cost incurred to return an item to us (subject to Clause 5.4 below).
5.3 Please note: any goods you wish to return to us must be unused, undamaged and returned in their original packaging, including all labels.
5.4 If items are delivered defective, damaged or not in accordance with your order, we will pay for the reasonable cost of their return within the 7 day period referred to above, but shall have no further liability to you.
5.5 We will process your refund via PayPal within 48 hours of receiving your returned goods.
5.6 Returns outside the 7 day period referred to above shall be at our discretion.
5.7 Please also note you are responsible for any loss or damage for your Peugeot goods from when they are delivered to you until when they are returned to us. For this reason, please only send items back to us via a trackable postal service and please keep your proof of return.
6.1 All Peugeot products we sell come with a one-year warranty, which means that if they become faulty within a year of purchase, you can make a warranty claim. You can make your claim through any authorised Peugeot Dealer in the United Kingdom who will at its discretion repair or replace the defective part in accordance with Peugeot Motor Company’s standard Warranty Procedure. They will require your original receipt of purchase from Peugeot Direct. For Warranty terms please see the Warranty section.
7.1 Subject to clauses 7.2 and 7.3, if either you or we fail to comply with these Terms, neither party shall be responsible for any losses that the other suffers as a result, except for those losses which are a foreseeable consequence of the failure to comply with these Terms.
7.2 In any event, we shall not be responsible for the following types of losses that may result from our failure to comply with these Terms: loss of income, revenue or profit; loss of business or business opportunities; loss of anticipated savings; loss of data; or any waste of time. However, this clause 7.2 shall not prevent claims for foreseeable loss of, or damage to, your physical property.
7.3 This clause 8 and these Terms do not exclude or limit in any way your or our liability for death or personal injury caused by our negligence; or fraud or fraudulent misrepresentation; or your statutory rights as a consumer regarding our ownership of the goods before sale to you; or our liability for defective goods under the terms of the Warranty (for further information about your statutory rights contact your local authority Trading Standards Department or Citizens Advice Bureau); or any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.
8. Force Majeur
8.1 We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
9.1 Any of these Terms that are found to be invalid, illegal or unenforceable will be deleted and severed from these Terms. Any items that remain enforceable will continue to be binding.
9.2 A person who is not party to the contract shall not have any rights under or in connection with it.
9.3 The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.
9.4 If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
9.5 These Terms shall be governed by and construed in accordance English law, and the parties hereby submit to the exclusive jurisdiction of the English Courts.
