By bidding on an auction or clicking on the 'Buy it now' button, on one of our eBay listings, you are agreeing that you have read and understood all of our Terms and Conditions listed below and any relevant policies linked from this web page.
Any reference to the words: we, us, our - means PCArena-Bristol, the Seller.
Any reference to the words: you, bidder, customer - means the eBay account holder who purchased the product on eBay, the Buyer.
Any reference to the words: contact us - means send us an eBay message.
Any reference to the words: carrier, carriers - means the delivery service we have used to send you order which includes but is not limited to Royal Mail, Parcel Force, UPS, Interlink Express.
1. Payment Process / Checkout Procedures
1.1 Once you have committed to buy an product or successfully won an auction you are required to checkout and complete eBay's secure payment process. You can either click on the secure "Pay Now" button on the auction to pay straight away, or otherwise, you can wait and buy multiple products and pay for them all in one.
1.2 Payment is required within one (1) day. If payment cannot be completed within one (1) day, please contact us to notify us of any delay. Stock is not reserved until cleared payment has been received and if payment is delayed we reserve the right to cancel and refund an order. We reserve the right to report any unpaid order to eBay via the unpaid item dispute process for recovery of our listing fees.
1.3 Payment methods accepted - Buyers can pay by PayPal or Bank Transfer. Orders will not be dispatched until full payment has been received and cleared into our account (PayPal or Bank).
1.4 We only ship to verified and/or confirmed PayPal addresses and reserve the right to refuse orders where delivery is requested to a non verified address. Any order requesting delivery to an unverified and/or unconfirmed PayPal delivery address may be subject to a checking delay and/or cancellation of order with a full refund.
1.5 VAT receipts and invoices - Value Added Tax is currently included in all our prices at the current rate. VAT receipts and invoices are included with all orders. Duplicate copies are available on request.
1.6 Customs & Excise Charges - When an order is shipped overseas we complete a customs form stating full value of the goods supplied in compliance with customs declaration laws. Overseas orders may be subject to additional charges for customs clearance relevant to the receiving country. We cannot mark orders as a gift.
2. Right to cancel
2.1 You have the right to cancel your order at any time up to the end of 7 working days after you receive the order. To exercise your right of cancellation, you must give written notice us by hand, post ,email or eBay message. You must give details of the goods ordered, eBay user-id and eBay item number. If you exercise your rights of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost. Return postage from Buyer to Seller is non-refundable under the Rights of Cancellation.
2.2 When you exercise your right to cancel we will provide a full refund of the order including any shipping charges paid to receive the order within a reasonable time frame.
2.3 You must take reasonable care of the goods and return them to us within a reasonable time frame.
2.4 If you exercise your right to cancel but then fail to return the goods, or return them at our expense, we reserve the right to charge you the direct cost of the return.
2.5 The right to cancel which is covered under the Distance Selling Regulations relates consumer purchases. If an order is made for or on behalf of a business there is no automatic right to cancel an order.
2.6 You cannot cancel your contract if the goods you have ordered are newspapers or magazines or if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you
3.1 We currently post worldwide. Local collection is only permitted if stated in the eBay listing.
3.2 Shipping Times - All our orders are dispatched Monday to Friday. For same day dispatch, payment must be received and confirmed by our sales order system before 15:00 hours for products that are sent by courier and 16:00 for products that are sent by Royal Mail. All orders placed on Saturday or Sunday or a Bank Holiday are dispatched on the next possible working day.
3.3 For any signed for delivery service upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty / refund claims that you make thereafter.
3.4 Delivery Times / Products Not Received for UK Destination Orders - All orders within the United Kingdom are either sent by Royal Mail or a courier service of our choosing. Please allow up to 15 days for standard delivery service and 2 days for expedited services from date of dispatch. We can provide information about your order before these timescales pass but cannot declare an order lost until they have passed. If these timescales pass and your order is still not received, we will resend (subject to stock availability) or refund your order. We reserve the right to report any lost product to the relevant authorities who may contact you for confirmation of non-receipt.
3.5 Delivery Times / Products Not Received for Non UK Destination Orders - All products are sent by Royal Mail Airmail or a courier service of our choosing. Please allow up to 20 working days from date of dispatch. We can provide information about your order before this timescale passes but cannot declare an order lost until it has passed. If this timescale passes and your product is still not received, we will resend (subject to stock availability) or refund your order. We reserve the right to report any lost product to the relevant authorities who may contact you for confirmation of non-receipt.
3.6 We keep a record of dispatch for all orders. If you order has not arrived and you would like more information please contact us by eBay message and we will provide a detailed explanation of where your order was dispatched to, when it was dispatched , the timescales involved and the steps that will occur if the order does not arrive.
3.7 Postage Costs - Please see individual product listings for specific shipping costs and delivery methods available.
3.8 Non-Receipt of Delivery - If delivery is not possible, because "no one is home" you will be left a card by the carrier to inform you. Please respond to the card to rearrange delivery or collect from the carrier's depot. If you fail to respond to any such card or the address provided by yourself is incorrect, the order will be returned to us. In these cases we reserve the right to request a further payment to cover the cost of resending your order.
3.9 Reporting Non-Receipt of order - If an order does not arrive you must report this to us within 60 days of our dispatch confirmation email for us to investigate why you have not received your goods. We will try to help with any report of non-receipt after this time however you will need to make your own claim against the carrier if over the 60 day period.
4. Warranty and Returns
4.1 All our products come with a 12-month warranty. If the your product fails to operate in the required manner within this time period, we will gladly accept the product back for repair or replacement.
4.2 Incorrect/Incomplete orders must be reported to us by an eBay message within 7 working days of receipt. We will then provide full instructions of how we will remedy the problem with your order and we will cover any extra postage charges you may incur if the order needs to be returned to us. You have the right to request a full refund instead of replacement in the 7 working days from receipt of your order.
4.3 Faulty products must be reported to us by an eBay message. If your product develops a fault within the first 30 days from receipt we will cover the cost of any return postage if we need the product returned to us. We will either replace, repair or refund your order in full if it develops a fault within the first 30 days from receipt.
4.4 If you return a faulty product after 30 days and product is out of stock or has been discontinued, your returned product will be sent back to manufacturer for repair or replacement with a similar or better specification product.
4.5 Return costs. If a faulty product is returned after 30 days from receipt the cost of return is the responsibility of the customer. If you return a product under clause 4.1 or 4.2 (within 30 days of receipt) we will cover the cost of postage used for 2nd class post unless otherwise stated in the returns authorisation message we send you. If you wish to use a more expensive postal service then please contact us for authorisation to do so.
4.6 Once you have contacted us to report a problem with your order we will reply with full instructions on how we will deal with your return and the steps you should take when returning the product to us.
4.7 If any of your products develop a fault, not withstanding 4.1 and 4.2, then provided your product is within its 12 month warranty period, you are entitled to a warranty repair or "like for like" replacement. In some cases, manufacturers provide a specialist full on-site service and/or telephone/web based help facilities for your convenience. Please contact us via eBay message and we will attempt to provide support or ask you to obtain support from the manufacturer. If after providing support via our support team or the manufacturers support team, we deem your product to be faulty, we will ask you to return the product back for repair/replacement.
4.8 Products should be returned in their original packaging complete with all accessories and documentation unless otherwise stated in the returns authorisation message we send you. Once we have verified the fault, we will issue a replacement or full refund to you via your original payment method.
4.9 If the returned product is sent back to us and we discover any parts missing and not previously reported to us we shall treat this product as incomplete. We will send a replacement and we will remove the "missing parts" from the new product before dispatch to complete the returned product.
4.10 We test all returned products. If a returned product is found not to be faulty we will let you know and reserve the right to return the product to you. We also reserve the right to request a payment to cover the return postage costs and a reasonable testing fee.
5. Returning Products
5.1 Before returning an product you must be in receipt of an RMA number issued by our support team.
5.2 All returned products must have the RMA number marked clearly on the outside of the parcel as explained in the return instructions we will send to you via an eBay message.
5.2 Any returned product without an RMA number clearly marked on the outside of the parcel may be subject to a delay in being dealt with or rejected and returned to sender.
5.3 All RMA numbers are valid for 30 days, after which you will have to re-apply for a new RMA number.
5.4 It is the buyers responsibility to ensure the product is packaged adequately and posted correctly. We are not responsible for any losses or damages to products if you do not follow these instructions. Returned products with signs of abuse or intentional damage will be refused and returned to sender at sender's cost
6. Feedback Policy
6.1 Due to the large number of feedback we receive each day, we use eBay's automated system for leaving feedback on receipt of feedback left for us.
6.2 We do not answer eBay messages, which are abusive or contain threats of leaving negative feedback and such messages will be reported to eBay.
7.1 We like to present accurate listings. If you can show us a mistake in a listing that has caused you to buy the incorrect product or for us to supply the incorrect product please contact us so we can resolve the mistake.
7.2 All images used are shown for demonstration purposes and are subject to change as our supply of products may change. We will still supply a product with the functionality and manufacturers part number as the listing describes. If you have any query about the way an product looks you must check with us before making your purchase.
7.3 We sell some products that are OEM meaning they do not have the retail packaging and limited/no instructions. We try to keep our listing up to date to reflect this however sometimes we may have to supply OEM products although not mentioned in the listing. All OEM products are still brand new and have the same 1 year warranty that retail boxed products have.
All orders are subject to acceptance and availability. If the Goods you have ordered are not available from stock, we will contact you by eBay message. You will have the option either to wait until the product is available from stock or to cancel your order.
9. Cancellation by us
9.1 We reserve the right to cancel the contract between us if:
9.1.1 we have insufficient stock to deliver the goods you have ordered;
9.1.2 we do not deliver to your area; or
9.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
9.2 If we do cancel your contract we will notify you by eBay message and will re-credit to your account any sum deducted by us as soon as possible but in any event within 30 days of your order.
10.1 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address or by email or eBay message of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable). If you notify a problem to us under this condition, our only obligation will be, at your option:
10.1.1 to make good any shortage or non-delivery;
10.1.2 to replace or repair any goods that are damaged or defective; or
10.1.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.
10.2 Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
10.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
10.4 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
10.5 Our liability for losses you suffer as a result of us breaching this agreement is limited to the purchase price of the Product you purchased.
10.6 We are not responsible for any indirect or consequential losses which happen due to the any loss or damage that would entitle you to cancel the contract between us, including but not limited to loss of income/revenue/ of business/ of profits/contracts/data/management time.
11. Law, jurisdiction and language
Our listings, any content contained therein and any contract brought into being as a result of usage of our listings are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
13. Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
