Online Terms & Conditions of Sale N.N.G Retail T/A Salus Bathrooms
By using or accessing our website and/or placing any order(s), you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then you may not use or access our website or place orders.
These terms relate to sales over the Internet and over the phone with Salusbathrooms.
The contract made by you on-line with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.
You should not proceed with your purchase until you have read and agreed to these terms and conditions.
We advise that no bookings are made with plumbers or tradesmen until you have received your goods and have checked them over for any suitability or potential damages. We will not be held liable for any plumber's cancellation fees.
1 Product Specification
1.1 We and our suppliers have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales. This includes adjustments to sizes or ornamental detailing on individual items purchased. Please email or call ahead to check exact sizes or potential ornamental changes as on occasions minor adjustments may have been made by our supplier.
1.2 Products supplied may differ as a consequence from those on display or advertised. Unless agreed with you, the products supplied will be of an equivalent value, functionality and appearance.
1.3 We endeavour to display as accurately as possible the colours of our products that appear on the website. However we cannot guarantee the complete accuracy of the pictures or photographs that are shown. Many conditions such as monitor settings and batching can affect the colouring of items in a picture.
2 Measurements
2.1 We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you, or minor alterations made by the supplier. Please email ahead if a small change in size may deem the item unusable.
2.2 All dimensions specified by us are approximate.
3 Prices
3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
3.2 The prices displayed on the website in relation to any on-line promotion are valid strictly until midnight on the day on which the promotion expires, as determined by us.
3.3 We will not be bound to honour any prices, where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases a refund will be offered.
3.4 Price is for item as described in title/description. All accessories are for illustration purposes only and not included within the sale unless otherwise stated
4 Payment
4.1 You must pay for the item(s) at the time of order. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.
4.2 Payment will be taken in full at the time of the order.
4.3 The contract shall not have been concluded until we have completed all of the following steps: we have received your valid payment details, we have accepted your on-line order and sent you confirmation of receipt of your order by return e-mail to the address you have given us during the ordering procedure and then we will then arrange to dispatched the goods to you.
4.4 We are entitled to refuse any order placed by you.
5 How long will delivery take?
5.1 Delivery on all in stocked goods is between 2-4 working days. Small items are sent with a delivery Courier on a 48hr delivery, this is 48 hours from despatch, in most cases the item will be despatched day following order, so will arrive in 3 working days.
Larger items will be dispatched by a pallet courier. Within 3 Working days of placing your order, you will receive a phone call or email to arrange a mutually suitable delivery date between 3 -14 working days.
5.2 Types of Delivery - As items very in size we use two types of delivery means, Carrier or our Road Haulage Pallet Company.
- Carrier: This will be delivered by a Carrier delivery man and will require a signature, if there is no one to accept the delivery, Carrier will re attempt the delivery the next day, if this isn't successful then a card will be left and the item will be taken to your local depot for re- delivery. Price for this delivery is £5.99 on a 48 hour delivery service (This is 48 hour from dispatch time). If item is shown as in stock, this will be despatched within 2 working days of order being placed, then a further 48 hours ( 2 Working days) must be allowed for delivery to be attempted.
- Other Courier (pallet deliveries): This is for all large items or bulk orders that require a pallet delivery. Once the order is complete we will contact you within 2 working days to confirm a day for delivery. Please note that the times of operation are Monday – Friday 9 - 5pm. Specific delivery times are only available with a further charge, we will advise this cost when booking the delivery. When your item is delivered there must be someone present at the address who can accept the delivery. Please note that this is classed as a Kerb side delivery service in which the person accepting the delivery must be able to assist with the item. The courier is not insured to take items into customer's houses. The delivery will be made on an ‘economy service' delivery, which can take up to 72 hours. Please note that this 72 hours is after despatch (date confirmed). The only time any extra cost will be charged is if there is no one at the address on the agreed date of delivery in which a £25 re-delivery fee will be incurred.
5.3 Receiving and Signing for your goods
Please inspect goods on arrival, look for obvious damages and report to driver. If the goods are not in a satisfactory condition mark the paperwork as damaged and accept the delivery please report this to us ASAP by e mail or telephone. If there are any signs of damage you must mark the delivery notes as "damaged". Do not return these goods with the carriers at this stage, please inform us of this by email or call 01253 408383 immediately and we will rectify the problems as soon as possible (This is essential as if this is not done it could affect your chances of a replacement since the delivery company will not entertain our claims for compensation if the delivery notes are not marked as "damaged”).
If the item is received, and no notification that the item is damaged is made on the delivery notes at time of delivery, we will be unable to rectify, replace or refund for the damaged item. We will be of the understanding that if the item is accepted with a signature of proof of delivery, this is an acceptance that the item (s) are in perfect order and fit for their purpose of use. Should you, for whatever reason, be unable to check the items at the time of delivery you must always sign as “unchecked” we will then give 24 hours to fully check all items. If damage is found we will require photographs of damage to be emailed to us in order to facilitate exchange or replacement of the item, this must be done within 24 hours of receiving delivery, no further liability on our part we be accepted after this time.
5.4 For all orders - any changes made to the content of your order will have an impact on your delivery date. We may therefore be unable to deliver your goods on your confirmed delivery date should changes occur and if so, a new delivery date will be given. Any subsequent charges by the courier will be claimed back from the customer.
5.5 You are responsible for providing a safe means of access from the public highway to the place of delivery. If our delivery staff consider that access is unsafe then we will not deliver the goods until safe access is provided. Any subsequent charges by the courier will be claimed back from the customer.
5.6 If our carriers accidentally damage goods in the course of delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.
5.7 Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of N.N.G Retail ltd or any reasonable rescheduling of delivery.
6 Returns, Refunds and Your Right to Cancel
6.1 You have the statutory right to return any products you have purchased within seven (7) working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including email) within those seven (7) working days. You will then be entitled to a refund from us less 20% restocking fee, which will be paid within thirty (30) working days of your notice of cancellation.
Goods must be complete, unused, and in 'AS NEW' condition (e.g. if you or the carriers have opened the box to examine the product it must have been done so without damaging the box and packaging or damaging the product in any way) and must be re-packaged as received and the packaging sufficient to re-sell the item as brand new. If the carriers unwrap this box the responsibility to ensure the packaging remains intact is with the customer. Please do not allow carriers or any other party to destroy any packaging, the packaging is specifically designed for each piece and is deemed as part of the item.
Should you wish to return the goods it is your responsibility to take good care of the Item(s). You are the owner of the item(s) once it has been delivered to you and you are liable for any loss or damage. Failure to take reasonable care may result in a claim against you by way of expenses deducted from and possible refund. To minimise the risk of any such claim we ask that you retain the original packing and use it when returning the item(s).
It is your responsibility to return the items to our delivery point in good condition and with the original packaging.
6.2 After the statutory 7 day period has expired we will be unable to accept returns of any items purchased unless faulty.
6.3 Subject to your statutory rights, products made or altered specifically for you, may not be returned nor will we provide any refund, unless they are defective or have been accidentally damaged by us in the course of delivery.
6.4 If we deliver incorrect or damaged goods, or in the event that you discover any defect in the goods for which you require compensation or other remedy, you must report the defect within 24 hours of the date you receive them. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided. We reserve the right to refuse return of items should the original packaging not be available to allow the safe return via our carriers. Should it be deemed impractical to offer a replacement, redelivery or re-selection of any damaged or faulty items we reserve the right to offer an allowance against a repair, or alternatively a refund for your purchase. Any non faulty items returned will always be returned at the expense of the customer, this includeds out going and return delivery cost even when stated as 'FREE DELIVERY'
6.5 We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.
7 Guarantees and Claims under Guarantee
7.1 The provisions of this clause 8 and clause 9 below, apply in addition to your statutory consumer rights in relation to faulty or misdescribed products. These rights are not affected by the guarantee.
7.2 The guarantor is N.N.G Retail Ltd, Unit 23 squires Gate Ind Est, Squires Gate Lane, Blackpool, FY4 3RN.
7.3 We guarantee all products against faulty workmanship and/or faulty materials period of 12 months from the actual date of delivery.
7.4 These guarantees do not cover fair wear and tear; neglect; abuse or misuse of your goods in failing to follow correct care procedures, loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party.
7.5 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights.
8 Site Content and Disclaimers
8.1 Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.
8.2 To the maximum extent permissible by law, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon the information contained on this website.
8.3 This site is owned and operated by N.N.G Retail Ltd, whose registered number is 6128412. VAT registration is 910 2655 56 Any material downloaded or otherwise obtained through the use of this website is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of any such material.
9 Applicable Law
9.1 We control and operate the web site from our offices within England. Accordingly the laws of England and Wales govern claims relating to, including the use of, this web site and the materials contained therein. If you choose to access our web site from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between ourselves and you the laws of England a and Wales will apply at all times. |
