General Information and Terms & Conditions

 

·      We will always describe condition, faults or problems as accurately as possible and we describe all items to the best of my belief and knowledge.

·      If you have any queries or questions regarding anything listed, please contact us before bidding.

·      Overseas bidders please contact us before bidding. We reserve the right to cancel a bid or to not complete the sale in instances where no contact is made.

·      We only accept payment via PayPal in Sterling from Overseas bidders.

·      Some of the items we list (usually the smaller/trial sizes), may be marked "Not for individual sale" or "GWP - Gift with purchase". If this is of concern to you, please do not bid. We will clearly identify these items on my listing.

·      We ask for the buyer or winning bidder to contact us within 48 hours of the auction finishing.

·      Items will be sent by 1st class or parcel post, unless we specify anything different in the listing or within a communication to you.

·      Sometimes, at our discretion, we may opt to send items by Recorded or Special delivery. If we choose to send an item(s) in this way, there will be no charge to the purchaser.

·      The postage costs charged include packing, packaging, administration, as well as the postal charge.

·      We always get proof of postage, but if a buyer should request proof of delivery, the buyer will be charged for this additional service.

·       When requested we are always happy to offer discounted postage on multiple purchases, despatched at the same time and to the same address.

·       We are happy to accept payment by PayPal, Postal Order or Cheque (made payable to Fran Gwilt). Please allow 7 working days from when we receive your cheque, for funds to clear. Your item will be despatched as soon as funds have cleared.

·      We aim to despatch within 2 working days after the purchase day, we will notify you by email when your item has been despatched

·      If you are unhappy in anyway, we ask that you please contact us immediately and we will deal with your query straight away. Please do not leave negative feedback without contacting us first.

·       We always leave feedback. We would appreciate it if you would leave feedback for us too.

·      Although we always try to resolve any non-payment issues. We will always report non-paying bidders to Ebay and will initiate NPB strike for non payers.

Terms & Conditions

These Terms and Conditions relate to the basis on which we trade on Ebay, we would advise you read them carefully as they contain important information.

 

Definitions

“We”, “Us” and “our” refer to The Maple House, Maple_house_store or Fran Gwilt.

“You”, “the Purchaser” and “Your” means the person making a purchase from The Maple House.

“Item/s”, “goods” and “product/s” refer to the item which is being purchased.

“Bidding” and “Buying” refer to the act of confirming your “commit to buy” on a item listed on Ebay.

 

General

The Maple House and the Maple House Store are Ebay identities of Fran Gwilt (referred to as “we” or “us”). The contact address is Netherlea House, Swalcliffe Lea, Banbury OX15 6ET. We can be contacted at this address or by email at sales@maplehouse.org

 

Rights

With acknowledgement to the VeRO, all photographic images of products used in our listings are the property of Fran Gwilt and as such cannot be used, modified or copied without express permission. Any infringement of this will be reported to Ebay and may result in relevant listings being removed. The Maple House name logo is a trademark belonging to Fran Gwilt, and cannot be duplicated or used without express permission. The exact wording and content of the Important Information page cannot be used or copied without expression permission.

 

Accuracy

We make every effort to ensure that products listed, have been fairly described and portrayed in our own words. Packaging may vary from that shown. We guarantee that all products are authentic, genuine and sourced from reputable wholesalers and suppliers.

 

Pricing

The price shown on a listing is valid for the duration of the listing. We are not registered for VAT.

 

Payment

We accept payment by Paypal, Postal Order and Cheque. Payment must be in GBP. A cheque will require 5 working days from receipt, for funds to clear.  Cheques must be made payable to Fran Gwilt, items will be despatched shortly after funds have cleared. If for any reason a payment fails, we reserve the right to cancel the sale. Title does not pass to the purchaser until cleared funds have been received.

 

Acknowledgment and acceptance of your order

We will confirm receipt of your payment. Our acceptance of your order will take place upon despatch of the product(s) ordered..

 

Unavailability

If, for any reason, an item is no longer available, you will be notified as soon as we are aware of the problem. If this situation arises, we will file a mutual withdrawal notice with Ebay. If a payment has already been made, a full refund will be issued immediately, via the original means of payment, for example PayPal will be refunded via PayPal. We are not liable for any other compensation, for example, consequential loss or for disappointment.

 

Delivery

Despatch will be made within 7 days of us receiving cleared payment. Delivery charges shown on listings relate to delivery to UK addresses only. Items will be sent by 1st class or parcel post, unless otherwise specified on the listing. The postage costs charged, include packing, packaging, administration, as well as the postal charge. Sometimes, at our discretion, we may opt to send items by Recorded or Special delivery. If we choose to send any item(s) in this way, there will be no charge to the purchaser. Overseas buyers must contact us before bidding/buying for post costs. We reserve the right to cancel the sale if contact is not made.

 

Complaints

If for any reason there is a problem with an item you receive, you must notify us by email within 48 hours, detailing the problem. We will acknowledge receipt of the complaint within 48 hours via email.

 

Returns

Faulty or damaged items

If you receive an item that is damaged or faulty, you must notify us of the problem within 48 hours of receipt. The item must be returned to us. The cost of the return postage will be refunded to you, once the item is received. We recommend you get proof of postage. We will replace or fully refund the item depending on availability.

 

Incorrect items

In the unlikely event that we send you the wrong item you should notify us of the problem within 48 hours of receipt. The item must be returned to us, unused, unopened and in the same condition as it was originally despatched. The cost of the return postage will be refunded to you, once the item is received. We recommend you get proof of postage. We will send you the correct item right away.

 

Non-receipt

Orders not received, which were dispatched by Standard Postage, will not be deemed 'missing' until 15 working days from the anticipated delivery date, have passed, therefore no resend or refund will be offered until after this period. Orders dispatched outside the UK must allow 28 working days.

 

Cancellation

As per the EU Distance Selling Regulations, you have a "cooling off period" of 7 working days from receipt, in which to notify us if you have changed your mind and wish to cancel for a refund. You must contact us within that time, by email, to confirm what is being returned for refund. You will be required to return the goods to us within 10 days, unused and in the same condition as they were originally despatched. We recommend you get Proof of Posting. You will be required to pay the cost of returning the goods. There will be no refund of the cost of returning the goods. All returned items will be thoroughly inspected. Due to the nature of the products supplied, we will not refund any item which has been used, tested or tampered with. You are under a statutory duty throughout the period of cancellation to take reasonable care of the goods. We reserve the right to take action against consumers for breach of this statutory duty. Refund of the cost of the goods will be issued once the return has been processed, this is usually within 7 days from our receipt of the return. The refund will be via the original means of payment, for example PayPal will be refunded via PayPal.

 

Statutory Rights
These Terms and Conditions do not affect your statutory rights as a consumer.

 

Law, Jurisdiction and Language
All sales are governed by English law and you agree to submit any dispute to the exclusive jurisdiction of the English courts. All communication must be conducted in English.

 

All transactions are subject to these terms and conditions, and no amendments will be accepted by us.
