Returning Goods

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from us. If an item is unsuitable when you receive it, provided it is returned in accordance with distance selling rights as detailed below in its original packaging and hygiene stickers are unbroken and not tampered with, we will be happy to refund the item. For health, safety and hygiene reasons, contraceptives, creams, sprays, latex and underwear, once opened, used or worn these items cannot be exchanged, refunded or credited unless faulty. Whilst we will deal with returned items as quickly as possible, please allow up to a maximum of 14 days for returned products. When returning any product please ensure you obtain a certificate of posting, this may be required by us, in the event of non receipt of your returned items.

Product Descriptions

We take great care in describing products as accurately as possible, we reserve the right to alter, withdraw or amend any description without prior notice, due mainly to manufacturers changes and improvements. It is sometimes necessary to send a substitute item or improved version of a product, if this is not acceptable to you, please notify us at the time of placing your order. Where dimensions and sizes are given, these are approximate. Colours and materials may differ slightly to those shown due to colour variations through electronic media and connection quality. If in doubt, please contact us before you order for clarification purposes.

Force Majeure

Magic Moments shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Liability Limitation

Subject to our obligations under the Consumer Protection (Distance Selling Regulations) Act or any relevant consumer protection legislation to give you a refund, if you cancel your contract or if we do not perform the contract within 28 days or any other agreed time, our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.

Data Protection Act

We are required like all bona fide businesses, to inform you that by submitting your order to us, means we will hold your details on our database for marketing purposes and so that we can process your order. By submitting your order to us you are giving your consent for us to do this. You have our assurance that your details will not be sold, rented or hired to any third parties.

Distance Selling Rights

Distance Selling Rights Cancellation rights apply to orders placed on this site. Notice that you wish to cancel your order should be given by durable medium at any time up to 7 working days from the day after delivery. You are advised that due to the nature of the goods that we sell, you are unable to cancel items that have been opened. If you wish to cancel any item, you should return the goods by 1st or 2nd class Royal Mail post, and a certificate of posting must be obtained. The customer is responsible for the cost of returning the goods in this instance. Returned goods should be addressed to MAGIC MOMENTS UNIT 4 BURGESS RD HASTINGS EAST SUSSEX TN35 4NR. Your statutory rights remain unaffected.

Health and Safety

Always follow manufacturers instructions on products received. If you have any medical condition, are taking medication, are pregnant or have any form of disability and you are in any doubt about a particular product, you should consult your GP or a qualified medical practitioner for their opinion before using any product. Wash products after use in warm soapy water, ensuring that any battery compartment is kept dry at all times. Condoms should never be used more than once.

Invalidity of Terms & Conditions

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law & Jurisdiction

The contract between you and Magic Moments shall be governed by English Law and you and Magic Moments submit to the exclusive jurisdiction of the English courts.
