TERMS & CONDITIONS for Internet sales
Minim Music trades in accordance with the Distance Selling Regulations 2000 (DSRs) that cover home shopping.
DSRs Terms and Conditions only apply to our items that are purchased on a BUY IT NOW basis. Items won in an online auction are not covered by DSRs and terms and conditions.
Minim Music try to ensure that all items listed for sale in Ebay are in stock. However, sometimes it is possible that an item listed could be purchased from our high street shop and then sold on Ebay before we have had chance to remove the item. If this occurs we will inform the customer and give them the opportunity to cancel the sale or wait for the item to be back in stock.
"Payments" are accepted by Paypal,Postal Orders & Cheques in £ GBP (Great British Pounds Sterling) & Telephone payments using debit/credit cards.
N.B Customers can pay via Paypal using their bank debit or credit card without the need to open a Paypal account.
Items purchased by Cheque or crossed Postal Order will only be shipped on receipt of cleared funds.
Cheques & Postal Orders can take upto 10 working days to clear. (Please note that a cheque payment that is shown drawn from your bank account may take several days to clear into the vendors bank account)
We do not accept payment in any currency other than £ GBP (Pounds Sterling). This includes cash, cheques & bank money orders. If you pay in any other currency we will not ship your goods and will treat the item(s) as unpaid.
Payment by direct bank transfer is not available.
All items with a cleared payment received before 2pm (Monday – Friday) will be posted out on the same day. Purchases completed after 2pm (Monday to Friday) will be posted out next working day. Purchases completed after 2pm on a Friday will be posted out Monday.
Under the terms and conditions of the Distance Selling Regulations 2000, the vendor has up to a maximum of 30 days to deliver purchased items to the customer.
A customer’s purchase is not considered undelivered for up to 15 working days (Monday-Saturday) from date of shipping.
Items undelivered will only be determined undelivered "lost in the post" after the 15 working day period from the date of shipping has passed. In the case of items sent overseas by Royal Mail Airmail, your item will not be considered lost for a period of 21 working days. Items sent by Royal Mail Airmail are not tracked. If the customer requires tracking then they must request an invoice total asking for tracking to be added. Tracking costs an additional £3.50 and your item will be sent by Royal Mail International Signed For Service. Please note that tracked mail overseas is no quicker than standard Airmail.
"Lost In The Post" Where the accepted time of 15 days for delivery has expired, Minim Music will send the customer a lost mail decleration form via email.
Minim Music will only be able to deal with a Lost Mail claim upon receipt of the completed lost mail decleration form from the customer. If a replacement item cannot be sent, a refund will be offered to the customer.
"Refunded Payments" Refunds may take upto 15 days to process from the receipt of the customers returned "Lost Mail Decleration Form".
RETURNS POLICY
"Cancellation Period" The customer has the right to cancel an order within seven working days from the day after the goods were delivered.
Customers must notify Minim Music of any cancellation of order by email, fax or written letter within 7 days of entering into a contract to purchase goods.
The customer does not have the right to return goods that by their nature cannot be returned unless they have a manufacturing defect. Eg. Instrumental Reeds, Harmonicas, Instrument Mouthpieces, Instrumental Hygiene Products, Guitar Strings that have been stretched, CDs & DVDs that have had their seal opened and Printed Music. These examples are not exhaustive or exclusive.
If an order is cancelled by the customer before shipping, Minim Music will refund the customer within 30 days of notification of the cancelled order.
If an order is cancelled by the customer after the item has been shipped, Minim Music will refund the purchase price of the goods only when they have been returned by the customer.
"Returning Purchased Items"The customer is responsible for shipping costs whent returning all cancelled orders.
Returned items must be shipped by a tracked or recorded service and in suitable packaging to avoid damage.
Minim Music cannot except responsibility for returned items that are lost or damaged in the post.
The customer will not be entitled to a refund for returned items that are deemed lost or damaged in the post. It will be the customers responsibility to make a claim against their shipping carrier.
All items returned should be in perfect re-saleable condition. eg. Items contained in sealed packets should be unopened and printed music books should be in perfect condition.
Any purchased items returned to Minim Music that are damaged will not be refunded. Damaged returned items will be held byMinim Music for a period of 3 months to allow the customer time to collect their property. After this period of time goods that remain uncollected may be disposed of.
Where goods are returned due to a manufacturing defect, Minim Music will pay for the cost of returning the goods on an agreed postal service and offer a full refund or replacement.
Refunds for faulty goods & shipping charges will be issued within 30 days. This is to allow time for Minim Music to check and return faulty goods to the manufacturer for inspection at their discression.
Where the manufacturer claims that there is no manufacturing defect and the goods have been mis-used (including unintentionally or accidently), damaged or neglected, Minim Music will not be obliged to offer a refund. Under these circumastancesif the customer wishes to have the goods returned they will be responsible for the shipping and packaging costs.
ITEMS SOLD ON EBAY AUCTION
Items sold on ebay auction format are not subject to the Distance Selling Regulations 2000.
All items sold on auction are sold as described and the customer is not entitled to return the item unless it is significantly different to that described in the auction.
If the customer chooses not to have their items sent by a recorded, tracked and signed for service, Minim Music will not be responsible for items lost in the post.
The customer must cover the cost of returning any item and obtain a return authorisation number from Minim Music before returning the item.
All returned goods must be sent via a signed for, tracked service. Minim Music will not be responsible if your returned item is lost in the post. |
