Terms and
Conditions for Use and Sales
1. Our eBay Auctions and Store
1.1 The terms: "we" "us" "I"
"me" represent n.e.ting/IPEX24/A Huntsman. The terms
"buyer" "purchaser" "customer"
"you" "your" represent the person considering or
placing any order/contract with us. The terms "they"
"them" represent any third party whom we or you may need to
deal with in respect of fulfilling payments, refunds, deliveries or
returns under these Terms & Conditions.
1.2 Respectively n.e.ting is our
user ID & IPEX24 is a proxy trading name of A Huntsman
and used on the hosting website by us, for you to identify who you are
trading with. These identifications are not needed when making any
contact via normal postal methods, either for notice of return, returns
themselves or any other contact. Full contact details are shown at the
end of these Terms & Conditions
1.3 Your use of any service we provide
or business conducted with us via our listings and shops via this
hosting (website) constitutes acceptance of these Terms & Conditions
& any Terms & Conditions or rules imposed or enforced by your
acceptance to your agreement with the hosting website.
1.4 We reserve the right to cancel
bids and/or block any buyer at any time without notice or reason.
1.5 Where "reason" or
"good reason" is implied or expressed within these Terms &
Conditions and or applied to auctions or purchases, it is the sole
judgment of ourselves.
1.6 With reference to working
days ...this includes all days other than Saturdays, Sundays and Public
Holidays
1.7 You must keep your contact details
up to date, including delivery addresses and email addresses as we use
both to fulfill your order.
1.7(a) Your email address is the first
point of contact we make for the confirmation of your order. This must
be current and able to accept communications from us via eBay messaging
& the email address provided below. Furthermore this must match your
PAYPAL account if you are using this method for payment.
1.8 Delivery address must be up to
date including postcode in the correct alphanumeric order. Many are not,
many are either missing incomplete or otherwise using numbers instead of
letters ....for example the number 0 (zero) instead of the letter O
(pronounced ..oh) or the number 1 (one) instead of the letter l
(pronounced ..el) this causes delays.
1.8(a) In rectifying the above [1.8]
we have in the past, had to search alternative data bases to try and
trace the correct information. We will no longer do this as this can
lead to misdirected shipping.
1.9 Any failed or returned
communications to your provided email may result in immediate
cancellation of your order. [See note 3.2, 3.3]
2. Product Pricing, Payments and Title
2.1 We make every effort to ensure that the pricing [including postage,
packing & handling charges] displayed in our listings are correct.
2.2 Individual listings will have
their respective price, postage, packing & handling charges
associated to them, this is not to be deemed as a final combinable or
un-combinable price with any or all other listings or purchases made.
2.3 Each listing is to be taken as an
individual win or purchase which may be available for combination with
other eligible wins or purchases.
2.4 The term "eligible
items" does not mean all items.
2.5 Eligible items
may be defined by either, payment, postage or other. For example but not
limited to payment, this may be an "instant payment" whereby
the goods remain on offer of sale until such time as payment is made.
(This is an ineligible item as it will not be combined with others in
whole or part, for postage discounts.)
2.5(a) It is the
prospective buyers responsibility to make sure they understand any
offers available.
2.6 Payments for all orders, single or
multiple should reach us within and up to five (5) days of your first
auction has ended or purchase has been made.
2.6(a) Where non payment occurs [2.6]
We reserve the right withdraw the offer to you & cancel your order.
Offering your win/s to the next highest bidder/s (auction Style) or
re-list of purchases (Buy it Now & fixed Price Listings)
2.6(b) Referring to [2.6(a)] where we
cancel your order there is no automatic right to reclaim said order via
repayment as those goods may have already been sold or re-listed and
supplies may not be available.
2.6(c) A recovery of any associated
lost fees [2.6a] will be initiated. This action may
2.7 A multiple order is grouped within
any consecutive five (5) day period and will be due for payment in the
same manner as [2.6] up to the fifth (5th) day of your first
win/purchase.
2.8 All Payments must be made in UK
pounds sterling.
2.8(a) UK payments can be via PAYPAL
online services with your credit/debit card or using your PAYPAL account
or by Postal Order. We do not accept cheques.
2.8(b) Overseas payments must be via
PAYPAL online services. The only exception to this is a Canadian Postal
Order made out in UK sterling. Any other form of payment other than the
aforementioned is refused.
2.8(c) echeque/echeck payments can
take longer than expected to clear, this will increase delays in the
shipping of your goods.
2.9 Title in any products won or
ordered from us does not pass to you, the purchaser, until we have
received and processed a valid payment, and that payment has been
cleared into our own bank account [postal payments] or online service
account and your order has been shipped.
3. Your Order
3.1 When you place an order you will
automatically receive a confirmation email from us to confirm your
order. Your order constitutes an offer made to us to purchase the goods
specified in the order.
3.2 We reserve the right to delay or
refuse orders where a transaction contains incomplete details or details
that cannot be verified or where fraud may be suspected.
3.3 If we are unable to reasonably
ascertain these details or resolve these issues a full refund will be
made against the payment type used at the time of purchase. No other
form of refund or credit will be offered nor will a refund be made to
any third party card or account.
3.4 Any bonus offered within an
auction or purchase is deemed to be an inclusive part of that order.
4. Shipping, Charges and Customs Duty
4.1 Shipping of your goods will
(normally [4.1a]) be within 24 hours of cleared payment arriving to our
accounts ..online or otherwise.
4.1(a) Unforseen circumstances may
delay the delivery of your goods.
4.2 We reserve the right to ship
products at a later date if the online payment is being held due to
echeque/echeck type payments or other reasons.
4.3 We cannot be held responsible for
disruption to shipping caused by industrial disputes or action outside
our direct control. If such disruption occurs you will be offered
delivery via an alternative delivery or fulfillment company or a full
refund.
4.4 If you are ordering a product from
outside the UK the recipient of the product is responsible for all
customs duties or tariffs incurred in the country (if appropriate) to
which the products are shipped. Furthermore your order may be subject to
delay or be opened and searched by local customs authorities when
entering the destination country. Please note we are unable to provide
specific advice on customs duties or tariffs.
4.5 All orders from outside the UK
will have any relevant (CN22) customs documents attached and conform to
any laws relating to these documents.
5. Cancellation Rights, Returns and Refunds
5.1 Under the Consumer Protection (Distance Selling) Regulations 2000
you have a right to cancel your purchase. However, to exercise this
right you must notify us in writing, (email or letter) within seven (7)
working days from the day after you receive your goods. You may also
cancel an order before you actually receive your goods. Goods should be
returned within fourteen (14) working days from the day after you
receive your goods.
5.2 As stated above notification of
cancellation must be in writing, a telephone call is not a valid
cancellation.
5.3 No returns are accepted once you
have used your product, unless the product is defective and you are
returning it for this reason.
5.4 Goods that are sealed or
shrink-wrapped including but not limited to CD's, DVD's etc, and this is
removed can only be returned if they are defective.
5.5 No right of cancellation exists
for commissioned, personalised goods or goods that are intimate in their
nature or goods where there may be issues of hygiene associated, unless
defective.
5.5(a) No right of cancellation,
refund or return exists under the Consumer Protection (Distance Selling)
Regulations 2000 for auction format listings The
Distance Selling Regulations apply to items purchased via Buy It Now
listings and Second Chance Offers on eBay.co.uk. However, they don't
apply to auction format listings on eBay.co.uk.
5.6 Any returned goods may subject to
independent tests to verify any consequential or inherent defects.
5.7 Please observe the following
procedure for all returns to us:
5.7(a) On the back of your delivery
note or on another piece of paper, (if you no longer have your delivery
note), include your ID or other identification, the item number and the
reason for the return.
5.7(b) If you are returning your
product because it is defective, please state the defect or defects.
5.7(c) Repackage the product in its
original packaging if possible, including any bonuses, accessories,
brochures, manuals, guarantees or warranties that came with the product.
5.7(d) Any bonus offered within an
auction or purchase is deemed to be part of that order and is returnable
along with the goods. Any goods returned without the accompanying bonus
will incur a charge to the appropriate value of the bonus ...Note: this
charge may be higher than your original order!
5.8 If the original packaging
surrounding the product has been damaged or destroyed we will only issue
a refund if the product is being returned due to a defect. If the
original packaging of a defective product has been damaged or destroyed
you should ensure that the returned product is adequately packed for
shipment back to us.
5.9 You are responsible for paying any
postage or shipping costs incurred when returning the product.
5.10 We recommend that all returns be
sent by registered post, so that you have a record of the return.
5.11 We will not issue refunds for any
items lost or stolen in transit to us.
5.12 Where a return is lost or stolen
in transit to us, you should claim compensation from the company that
shipped the return.
5.13 If you fail to return a product
to us, we may make arrangements to have the product collected from you.
The cost of this collection will be passed on to you.
5.14 Unused products may be returned
promptly within 14 days by customers to the address listed below.[5.17]
5.15 Subject to [5.14] we will refund
the purchase price of a returned product within thirty [30] days of
receiving written notification of your intention to return the product.
5.16 We will also refund the cost of
standard or recorded postage incurred returning a product, if
incorrectly sent by us or where the product has been returned due to a
defect. Please note that we will not refund any courier, overnight or
express element of any delivery or postage charge, including Royal Mail
Special Delivery.
5.17 Returns can be sent to the

6. Product Display
Whilst every effort has been made
to display the colours of our products as accurately as possible within
our listings, the actual colours you see will depend on your own
monitor. We can not guarantee that the colour displayed on your monitor
will accurately reflect the colour shown on the listing or of the
product on delivery.
7. Faulty Products
If you experience a fault with a product it can be returned to us
subject to our returns policy above.
8. Reasonably Foreseeable Losses
8.1 n.e.ting/IPEX24/A Huntsman will be liable for any
losses incurred by you due to breaches of these Terms & Conditions
by us, where such losses were reasonably foreseeable at the time the
contract between you and us was made.
8.2 All indirect or consequential
losses not reasonably foreseeable at the time of the contract between
you and us are excluded.
8.3 We do not exclude or limit
liability for death or personal injury caused by the negligence or
breach of duty by us, our employees or officers.
9. Complaints
We
endeavour to respond to all customer complaints or queries within five
working days.
10. Severability
The foregoing paragraphs, sub-paragraphs and clauses of these Terms
& Conditions shall be read and construed independently of each
other. Should any part of this agreement or its paragraphs,
sub-paragraphs or clauses be found invalid it shall not affect the
remaining paragraphs, sub-paragraphs and clauses.
11. Waiver
Failure by n.e.ting/IPEX24/A Huntsman to enforce any accrued
rights under these Terms & Conditions is not to be taken as or
deemed to be a waiver of those rights unless we acknowledge the waiver
in writing.
12. Entire Terms & Conditions
These Terms & Conditions set out the entire agreement and
understanding between you and n.e.ting/IPEX24/A Huntsman. We
reserve the right to change these Terms & Conditions at any time,
without giving notice to you. Your statutory rights are unaffected.
13. Jurisdiction
These Terms & Conditions shall be interpreted, construed and
enforced in accordance with English law and shall be subject to the
exclusive jurisdiction of the English Courts.
