Important points in regards to Distance Selling Regulations

3.58 "Can I insist that consumers who cancel an order within the cancellation period return the goods as new or in their original packaging?"

No. Consumers are under a duty to take reasonable care of the goods while in their possession as discussed in paragraph 3.44. The DSRs allow consumers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods then they have not breached their duty to take reasonable care of the goods. In these circumstances you cannot insist that consumers return the goods as new or in their original packaging. You may ask consumers to return goods with the original packaging, but you cannot insist on this. In the case of goods such as earrings that have hygiene seals, you may require consumers to exercise reasonable care by not removing the seals when examining them.

  • "The DSRs allow consumers to examine goods they have ordered as they would in a shop."
    Please bear this in mind and use common sense when examining goods. Anything that could lead to someone being escorted to the nearest till to pay under the "you break it, you buy it" policy in a shop would be considered a breached of duty to take reasonable care of the goods.
  • For new items, the display box and all its contents are considered the product. While the box, bag or envelope it was sent in is considered the original packaging, the display box is part of the product and consumers are to exercise reasonable care when examining it.
  • Due to the extremely sensitive nature of electrical components - merely touching the component without first discharging oneself of built-up static electricity can permanently damage the component and render it useless - buyers must take reasonable care by not removing or tampering with the seal of anti-static bags while examining goods.

    • The cosmetic appearance of refurbished items;
    • Software and hardware issues unrelated to those originally purchased;
    • Networking issues unrelated to any hardware fault.
  • All customers are responsible for initial shipping and initial shipping costs if the item is to be returned to us:
    • If the item is returned within 30 days of purchase due to a fault and the technicians confirm the faulty on receipt, we will refund the shipping costs up to an amount equal the original sale P&P and up to a maximum of £6.99.

  • For orders outside the UK mainland, the buyer will be liable for costs above the standard UK mainland rate.
