These terms and conditions set out the basis on which you can visit and use our Ebay store. Please read them carefully as they contain important information.

1. General

These terms and conditions ("the Terms") apply to your use of this Ebay store (the "Ebay store"). By accessing this Ebay store and/or placing an order you agree to be bound by these Terms. If you do not agree to be bound by these Terms you may not use or access this Ebay store. If you do use the Ebay store, this will be taken to mean that you agree to be bound by these Terms.

1.1 In these Terms, unless the context requires otherwise:
" AIM" means the AIM Ebay store on www.ebay.co.uk
" Contract" means each contract for the supply of Goods by AIM into which these Terms shall be incorporated;
" Goods" means the products which we supply in accordance with these Terms;
" Order" means a purchase order in respect of the Goods issued by you to us.
1.2 This AIM Ebay store is operated by Avon Polymer Products Limited (trading as Avon Impact Management or AIM), a company registered in England and Wales and a subsidiary of Avon Rubber plc. The registered office of Avon Polymer Products Limited is Hampton Park West, Semington Road, Melksham, Wiltshire SN12 6NB and its company registration number is 00149360. The VAT number is GB137575643.
1.3 AIM reserves the right to change these Terms from time to time. Changes will take effect when posted on the Ebay store and it is your responsibility to read the Terms on each occasion you use this Ebay store. Your continued use of the Ebay store shall represent your willingness to be bound by the latest Terms.
1.4 There may be legal notices on other areas of this Ebay store which relate to your use of this Ebay store, all of which will, together with these Terms govern your use of this Ebay store.

2. Acknowledgement and acceptance of your order

2.1 If you have supplied us with an email address, we will send you a confirmation email on receipt of your Order. You will then be sent another email confirming despatch of your Goods. All Orders will be subject to our acceptance in accordance with these Terms. Our acceptance of your Order will take place when we dispatch the Goods to you.

2.2 AIM has taken every care in the preparation of the content of this Ebay store, and in particular to ensure that the prices quoted are correct at time of publication and the Goods have been fairly described. However, please note that we may only accept Orders if there are no material errors in the description of the Goods or their prices as advertised on this Ebay store. Identification of a pricing or product description error by us may result in non-acceptance of an Order.

2.3 All of the products for sale at AIM are subject to availability. If we experience problems with availability and are unable to supply your goods, we will send an email informing you of this as soon as possible. Where the goods have already been paid for, a refund will be issued.

3. Pricing

3.1 Except for the addition of delivery charges (see below), the prices stated by us at the time we receive your Order are the prices you pay except where we discover an error in the price of the Goods you have ordered. In this event, we will inform you as soon as possible after receiving your Order and will cancel the sale. If we are unable to contact you we will treat the Order as cancelled.

3.2 All prices are displayed on the Ebay store in pounds sterling and are inclusive of VAT at the prevailing rate charged in the UK.

3.3 Prices that are reduced for sales and promotions are only valid for the specified period. We reserve the right to adjust prices, offers, goods and specifications of goods on the Ebay store at our discretion at any time before (but not after) we accept your Order.

4. Delivery

4.1 Delivery charges vary according to the Goods and the number ordered and are quoted in each product listing.  

4.2 Unfortunately, we are unable to provide an exact time of delivery, but it is estimated that Goods will be delivered within the following timeframes after payment has been received and cleared:

UK mainland  - 3 to 5 working days

Anywhere else in the EU- 5 to 7 working days

Outside Europe- 7 to 14 working days

All Goods will be delivered by courier and will require a signature as proof of delivery.

4.3 If we experience unexpected problems with availability and are unable to deliver your order within the above estimates, our customer service team will send an email informing you of this.

4.4 Currently, we only ship regularly to the UK and therefore are not able to accept orders through the Ebay store from customers outside this region. Customers from outside the UK should contact sales@avon-impact.com.  AIM can deliver your goods to any address within the UK including the Highlands of Scotland, Northern Ireland, Channel Islands and the Isle of Man.

4.5 All of our items are subject to stock availability. Please be aware that we cannot accept liability for any expenses incurred because of delayed or unsuccessful deliveries. We will always endeavour to get your purchase/s to you within the delivery timescale specified, however, we cannot guarantee that deliveries will be made within this period, nor accept liability for deliveries that are made outside of it.

5. Returns

5.1 We take pride in the quality of our products and hope that you will be completely satisfied with your purchase from the AIM Store on Ebay. However, if, after examining your purchase on arrival, you do wish to return a product for any reason, you may do so within 14 days of the receipt of goods.

5.2 To return an item, simply complete the returns form contained within your delivery paperwork and send this back to us along with your purchase in its original packaging to:

5.3 If you have more than one item to return, please ensure that this is detailed on the returns form and that, wherever possible, that they are packed together.

5.4 As risk of loss or damage to the parcel is the customer's responsibility until it is received by AIM, we advise that the package is sent using a reliable courier service that offers insurance. AIM cannot accept liability for parcels lost in transit to us.

5.5 Once the parcel is received, the value of the returned product(s) at the time of purchase will be refunded in full via PayPal no later than 30 working days after we receive the returned Goods. We will refund the full price of the product, providing it is in a saleable condition and is in its original, undamaged packaging. The delivery charge is non-refundable.

5.6 For larger items, you may like us to collect the Goods from you and, in this circumstance we will quote a collection charge. This will be deducted from your refund when we process your return. To arrange collection, please contact our customer service team on sales@avon-impact.com.

5.7 If you have received an item that is damaged or faulty, then please contact our customer service team within 14 days on sales@avon-impact.com.

5.8 Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods.

6. Warranties and liability

6.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraudulent misrepresentation.

6.2 In the absence of any negligence, other than breach of duty by AIM, your use of any Goods other than in accordance with their operating manuals and/or instructions is entirely at your own risk.

6.3 AIM will make every effort to deliver Goods within a reasonable time from the date of your Order and to comply with our obligations under these Terms, but we cannot be held responsible for delays or failures due to adverse weather, traffic delays, mechanical breakdowns or other circumstances beyond our control.

6.4 The information contained in the material in this Ebay store is only for information purposes. AIM, by permitting the use of this Ebay store, does not hold itself out as providing any legal, financial or other advice. It also does not make any recommendation or endorsement as to any investment, advisor or other service or product or to any material submitted by third parties or linked to this Ebay store. The material on this Ebay store does not constitute advice and you should not rely on any material in this Ebay store to make (or refrain from making) any decision or take (or refrain from taking) any action.

6.5 The Goods are sold in accordance with the manufacturer's specification, subject to any qualification or representation contained in the Ebay store. AIM do not make any other promises or warranties about the Goods.

6.6 We will take all reasonable precautions to keep the details of your Order secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

6.7 If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those losses which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.

7. Intellectual property

7.1 Unless otherwise specified the copyright in the contents of all the pages in this Ebay store are owned by Avon Polymer Products Limited.

7.2 AIM and other marks indicated on this Ebay store are trade marks or registered trade marks of Avon Polymer Products Limited or Avon Rubber plc. The Ebay store's graphics, logos, page headers, button icons, scripts and service names are the trade marks or trade dress of AIM. AIM's trade marks and trade dress may not be used in connection with any product or service that is not AIM's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits AIM. All other trade marks not owned by AIM that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AIM.

7.3 Except as stated in this condition, the contents of this Ebay store may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, posted, re-posted or transmitted in any form or by any means without the prior express written permission of AIM. You may not distribute, display or copy any of the contents of the pages contained in this Ebay store to third parties including, but not limited to, "caching" any material on this Ebay store for access by third parties and "mirroring" any material on this Ebay store. You may print the contents of an individual page of this Ebay store for the purpose of private and personal non-commercial use.

Please provide full details of the nature of your complaint, including the products purchased, your order number, your name, address, daytime telephone number, email address and any other information which you think will assist us in resolving your problem as quickly as possible.

9. Business use

If you are planning to use the Goods for business purposes you should make sure that you are covered by the appropriate insurance. Where you decide to use the Goods in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of Goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

10. Miscellaneous

10.1 A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.

10.2 Each Contract shall be governed by and construed in all respects in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the courts of England and Wales. Where national regulatory authorities have jurisdiction over the contents of this Ebay store, AIM has attempted to ensure compliance with the requirements of such regulatory body. However, some of the information in the pages contained in this Ebay store is not to be accessed from certain jurisdictions and no representation or warranty is made as to whether the information available in this Ebay store complies with the regulatory regime of countries from which the pages in this Ebay store should not be accessed.

 AIM does file details of your order, however, we will not sell, share, or rent this information. Your privacy is of the highest importance to us, and we agree never to release your personal details to any outside company for mailing or marketing purposes without your express permission.
