Acceptance of general terms of sale

1. The contract stipulated between Arte dal Mondo S.r.l. and the customer shall subsist with the acceptance of the order, even if only partial, by Arte dal Mondo. Such acceptance will be considered tacit, if no other different communication is given to the customer.

By sending an order, the customer declares to have taken into consideration all the indications given during the purchasing procedure and to completely accept the general conditions and payment terms written as follows

2. If the customer is the user as well, once on-line purchase is concluded, he is expected to print out or save the achieved on-line purchasing practise and to keep available these terms of sale, according to Italian Law (Dlgs 206/2005).

3. The customer has no right of damage reimbursement, indemnity or contractual and extra-contractual responsibility for direct and indirect damages to people and/or things, due to a lack, total or partial, of an order acceptance.

Purchasing procedures

4. The customer is allowed to purchase only the products shown in the Arte dal Mondo’s electronic catalogue at the moment of the order sending and visible on the web site (URL) www.artedalmondo.it, or available on Arte dal Mondo S.r.l. Ebay website, at on-line auction or at fixed price shop. Such products are intended to be sold as illustrated and/or described in their related informative reports.

5. A message of reply sent by Arte dal Mondo to the customer’s email address will confirm the correct receipt of the order. The confirmation message will contain all the details inserted by the customer, and this last is expected to check their correctness and to communicate any correction immediately, in the manners laid down by this document.

6. In case of non-acceptance of the order, Arte dal Mondo S.r.l. assures a timely communication to the customer.

Payment procedures

Payment procedures
7. Credit card through Paypal or Banca Sella
In case of payment with credit card through Paypal service or Banca Sella, to coincide with the on-line order settlement, Paypal and Banca Sella will authorize the only amount related to the purchased ordered.
7.1 In case of cancellation of order, either because of the customer decision or because of the non-acceptance by Arte dal Mondo S.r.l., the company will immediately ask for the payment settlement annulment and the corresponding amount redeeming. The necessary redeeming time depends only on Paypal service system or on Banca Sella.
After the cancellation has been processed, Arte dal Mondo S.r.l shall not be responsible for any direct or indirect damage, due to any delay in redeeming the amount by Paypal system service or by Banca Sella.
7.3 In any moment during the purchase procedure, Arte dal Mondo S.r.l. is able to gather information about the customer’s credit card, as they have been directly transmitted to Paypal web site or to Banca sella  through a protected connection system. No electronic file containing these data will be collected by Arte dal Mondo S.r.l.
For this reason Arte dal Mondo S.r.l. shall not be held responsible for any fraudulent or undue usage of credit cards by third parties, at the moment of paying products, which had been bought on its own web site www.artedalmondo.it nor on Ebay on-line auction.

8. Cash on delivery

Cash on delivery can be used only to pay paintings sent in carton pipe packages.

The delivery service is performed by the Post Office, that usually adds to the receiver an additional delivery charge, whose amount depends on the country or place of destination. It is customer duty to get informed about additional charges, not included in the cash on delivery amount. Arte dal Mondo S.r.l. will not accept any unexpected added delivery cost as reason for refusing the goods. This way of payment is allowed only for those Countries where the Italian Post Office practises this kind of service.

8.1 in the cases where a cash on delivery shipment returns back to the sender, for reasons not depending on mistakes or omissions of Arte dal Mondo S.r.l., both shipment and return costs will be charged to the customer anyways.

9. Bank transfer in advance

In case of bank or postal transfer in advance, Arte dal Mondo S.r.l. will keep the ordered goods as reserved for a period not longer than 10 working days from the order sending date; after this period the company reserves the right to dissolve the contract. Should the payment arrive after the contract cancellation, Arte dal Mondo S.r.l.  will arrange not to execute the order but it will arrange for reimbursing the customer of the paid amount, reduced of any met expenses, by bank transfer within 14 working days from the payment receipt day. In order to receive the reimbursement, the customer has to timely provide the company with his bank information (ABI – CAB – bank account number of the invoice holder’s or IBAN BIC and holder’s bank account number if the customer does not live in Italy).

The bank transfer description must quote the following details:

• order number;
• date of order sending;
• name and surname of the order holder.

Arte dal Mondo S.r.l. will send the ordered goods only after the payment settled in its bank account.

10. Postal order in advance

The postal order payment service is available only for the customers living in Italy. In case of prior postal order payment, Arte dal Mondo S.r.l. will keep the ordered goods as reserved for a period not longer than 10 working days from the order sending date; after this period the company reserves the right to dissolve the contract. Should the payment arrive after the contract cancellation, Arte dal Mondo S.r.l. will arrange for reimbursing the customer of the paid amount, reduced of any met expenses. Arte dal Mondo S.r.l. will send the ordered goods only after receiving the postal order.

Delivery and costs procedures

11. An invoice referring to the dispatched goods will confirm each order sent to Arte dal Mondo S.r.l. This document, settled according to Italian Law (art. 14 D.P.R. 445/2000), is sent to the order holder by post – the data provided by the customer at the order sending are used for settling the invoice. No information changing will be possible after settling the invoice.

12. The delivery costs are charged to the customer and are explained at the order confirmation. The payment of the goods will then be the type chosen at the order sending. The customer must pay nothing more than the total amount of the order underlined at the end of the purchasing procedure.

13. The delivery costs show in the web site www.artedalmondo.it or in Ebay advertisements are just approximate and not binding for Arte dal Mondo S.r.l. The customer is expected to ask Arte dal Mondo S.r.l. for costs confirmation, with reference to the place where the delivery has to be sent. This is particularly for cases of delivery to islands, inconvenient places or historical areas.

14. Arte dal Mondo S.r.l. has no responsibility for any delay in the order dispatch or goods delivery.

15. On goods delivery by the courier or the post service, the customer is expected to check:

• That the delivered items corresponds to the ordered ones;
• That the package is complete, not damaged, nor wet or altered even in the closing parts (such as tape or hoop-iron)

Any damage or wrong item shall be immediately communicated to the deliverer. Once the customer has signed the delivering document, he will no longer have any right to contest the delivered goods external features.

Problems related to physical integrity, correspondence or completeness of the received products must be communicated within 7 days from the delivery date, according to the terms foreseen in the present document.

16. In case of non-collection, within 5 working days, of the goods stocked at the courier warehouse or post office, because of repeated impossibility of delivery to the address indicated in the customer’s order, the order will be automatically cancelled. In this case and in all cases of goods not delivered to the customer because of mistakes or omissions not imputable to Arte dal Mondo S.r.l. or to the courier who the goods were entrusted to, the order will be automatically cancelled and Arte dal Mondo S.r.l. will arrange for reimbursing the customer the amount transferred, reduced of the total amount of all met expenses.

Right of withdrawal

17. According to Italian Law (art. 5 Dlgs 206/2005), if the user is a consumer (a person who buys the goods for usages not referred to his own professional activity, which means he fulfils Arte dal Mondo S.r.l. purchasing order without indicating any VAT number), he has the right to withdraw from the contract for any reason, with no need for explanation and without any penalty, except for what explained at point 19.

18. In order to enjoy such right, the customer must send a letter to Arte dal Mondo S.r.l. about this matter within 10 working days from the goods receipt date. This communication must be a registered letter with receipt notification and adressed to

or rather by telegram or fax, still to be sent within 10 working days, and followed by a confirm through a registered letter with receipt notification which has to be PEREMPTORILY sent within the next 48 hours. As soon as Arte dal Mondo S.r.l. receives the receding communication, the Customer Service will inform the customer about the goods return modalities, which have to be arranged within the next 48 hours.

19. The receding right must in any case be submitted to the following conditions:

• This right is not referring to products particularly based on customer’s specification or on customer’s drawings still less it is referring to modified and assembled products with other ones on request of the  customer.  
• This right is referring to the entire product bought: it is not possible to recede only for a part of it.
• To return the shipment it is necessary to repack the goods in its whole original packaging (including any burlap, usage manual and component parts) to limit any damage to the original packaging, we recommend, when it is possible, to insert it in a further second package.
• According to law, the return cost will be charged to the customer;
• The customer is fully responsible for the goods during the return transport; until the receipt of the goods in our warehouse has been fulfilled.;
• In case of damaging during the transport, Arte dal Mondo S.r.l. will notify it to the customer (within 5 days from the goods receipt) in order to let him timely complain to the chosen courier and obtain the reimbursement of the value (if insured); in this last case, the goods will be available for being returned to the customer and at the same time his withdrawal request will be annulled;
• Arte dal Mondo S.r.l. cannot be held responsible for item damages or theft/loss of any return item by no insured shipment;
• At the moment of the warehousing the goods will be checked to verify probable damages or tampering not caused by transportation. Should the box and/or the original package be damaged, Arte dal Mondo S.r.l. will deduct a percentage from the reimbursing amount, not higher than 10%, as package reset cost.

20. Except for any resetting charges for liquidated damages to packaging, Arte dal Mondo S.r.l. will arrange for refunding the customer for the amount paid reduced of all charges due to executing and shipping the order as well as due to the takings and to the return of payment. Except for any other instructions from the customer, the reimbursement will be effected through a Bank Transfer within 14 days from the goods receipt. The customer is expected to provide us in good time his bank information where to get the reimbursement    ( ABI-CAB-Current Account Number of the invoice holder or IBAN BIC and the holder’s Current Account Number if the customer is not resident in Italy).

21. The withdrawal right does not apply, when the main condition of integrity of the item is missing (package and/or its contents), in the cases when Arte dal Mondo S.r.l. verifies that:

• the external package and/or the internal burlap in the original package is missing;
• one or more component parts are absent;
• the damage has not been caused by the transport;

In case of loss of the receding right, Arte dal Mondo S.r.l. will arrange for sending back to the customer the item bought, against payment of shipping charges.

Guarantees

22. Each product sold by Arte dal Mondo S.r.l. are supported with the official producer guarantee: a minimal validity period of 24 months for the user (a person who buys the goods for usages not referred to his own professional activity, which means he fulfils Arte dal Mondo S.r.l. purchasing order without indicating any VAT number); a validity period of 12 months for companies or professional usages.

23. The warranty covers any conformity flaw and/or wrong operation unknown at purchasing, as long as the product itself is used in the proper manner and with diligence, in other words respecting its usage and what has been foreseen in the technical information.

24. Any reparation during the validity period is covered by Arte dal Mondo S.r.l. at its seat. Transport costs, both related to the damage product sending and the repaired product receiving, are charged to the customer, if not differently specified at the order sending.

25. Should be notified that the problem is not due to any product conformity flaw, the reparation cost will not be covered by the guarantee, but then charged to the customer for its testing, checking and product resetting expenditure.

26. In the case when, for any reason, should Arte dal Mondo S.r.l. not be able to give any suitable product under warranty (restored or substituted), the company itself will coordinate on its discretion for refunding the whole paid amount or replacing it with another product, featuring same or higher quality characteristics.

27. No indemnity shall be claimed to Arte dal Mondo S.r.l. in case of delay in the product reparation or replacement.

28. In all cases, the item to be repaired or replaced, shall be returned from the customer in its original repackage, completed in all parts (including burlap and probable instruction booklet and accessories parts); to limit any damage to the original packaging, we recommend, when possible, to place it in a second package.

29. Arte dal Mondo S.r.l. usually provides for the buyers of some of its products with a certificate of Authentication, in order to validate what the on-line product descriptions depicted. These documents are called “Certificate of Guarantee” for simplicity, but they do not refer to the technical guarantee or to the product integrity. This documentations are addressed to the customer private usage only and do not bind in any way Arte dal Mondo S.r.l. to third parts. No damage will be acknowledged by Arte dal Mondo S.r.l. for any different use of these certificates. The release of these documents must be demanded at the order sending. Should the request arrives to Arte dal Mondo S.r.l. after the order dispatching, the customer will be then asked to pay for the document sending charge.

Privacy

30. The personal information requested while forwarding the order are collected and handled with the purpose of meeting client’s requirements and they will not be given or traded to any third parties in any case.

Arte dal Mondo S.r.l. assurse its customers the respect of the set of rules regarding personal information treatment, disciplined in Privacy Code, in accordance with DLGS 196 del 30.06.03.

Disclaimer

31. Each complaint shall be notified in writing and sent to Arte dal Mondo S.r.l. - Via Colombo 13, Gorla Minore (VA) Italy.

Governing law

32. The contract of sale between the customer and Arte dal Mondo S.r.l. is retained to be concluded in Italy and governed in accordance with the Italian Law. For any civil and penal dispute arising from the conclusion of the present remote sale contract, the territorial competence is exclusively reserved to Foro di Milan.
