Website Conditions of Usage

This website is operated by All Pond Solutions Limited (we/us/our). As a user (you/your) of this website you acknowledge that any use of this website including any transactions you make is subject to our terms and conditions outlined below. Please read through these terms and conditions thoroughly before using this website. We reserve the right to amend these terms and conditions at any time.

 

 

Data Protection

1.1 Any and all data obtained by us through your usage of this website will be held in absolute confidence in accordance with the Data Protection Act 1998 and will not be shared with any third-party or affiliate under any circumstances.

1.2 All information that you provide must be accurate and complete. Any passwords entered by you are exclusive to your account and must be treated as strictly confidential.

1.3 Password and account facilities may be altered and withdrawn at our discretion.

1.4 You must treat your account as strictly confidential and subject to usage by the account holder (you) only. Under no circumstances must you allow anyone other than you to access your account.

1.5 We reserve the right at our discretion to cancel your account facilities at any time.

1.6 We will take all reasonable precautions to keep the details you provide secure but, unless we are negligent, we accept no responsibility or liability for any losses caused as a result of unauthorised access to information provided by you.

1.7 We will not store on file any credit or debit card information under any circumstances.

Purchases

2.1 Any and all purchases made at our website are subject to our terms and conditions.

2.2 Purchases on our website may be initialised by clicking “add to basket” on each individual item page.

2.3 By confirming your purchase after reviewing your checkout basket your order will be subject to acceptance by us at all times.

2.4 Acceptance of your order and the completion of your contract with us will occur upon despatch of your item from our business outlet. We reserve the right not to accept your order at our discretion.

2.5 Any cancellation by you of your order must be made prior to despatch to avoid any additional costs of return.

2.6 Confirmation of your website order will be sent via email to your registered email address provided.

2.7 Any and all order shortages or mistakes must be notified to us within 24 hours of acceptance of goods under all circumstances.

 

 

Value Added Tax (VAT)

3.1 Value Added Tax is applied to all applicable website sale items subject to VAT regulations.

3.2 VAT will be applied at the current rate of 20%

3.3 All listings on our website are displayed priced inclusive of VAT unless otherwise stated.

Delivery

4.1 We will only ship to delivery destinations as outlined upon checkout, refer to our Frequently Asked Questions for a more detailed list of countries we ship to.

4.2 All item prices on our website are inclusive of UK mainland postage unless otherwise stated.

4.3 UK deliveries to Scottish Highlands, Scottish Isles, Channel Islands, Isle of Man, Isle of Wight and Northern Ireland will be subject to a delivery surcharge. Please see delivery terms page.

4.4 Orders sent via “Royal Mail Tracked Delivery” are sent ‘no signature required’ as standard.

4.5 All orders subject to “Royal Mail Tracked Delivery” will be tracked independently by Royal Mail.

4.6 All orders sent via “UPS” or similar courier must be accepted with a signature upon delivery under all circumstances.

4.7 Your acceptance of our goods in good order is confirmed in all cases by your acceptance of delivery.

4.8 We usually only provide tracking information if your order has failed to arrive after 4 days of initial despatch. Delivery timescales are not guaranteed.

4.9 Goods will only be deemed as lost if a) we cannot locate them through tracking b) items fail to arrive within 28 days of initial despatch.

4.10 Any goods deemed as lost will be replaced subject to varying delivery timescales.

4.11 We are not obliged to provide delivery details and as such all delivery information is supplied at our discretion only.

4.12 All international orders will be despatched using “Royal Mail Air Mail” or a suitable Please allow up to 28 days for delivery of standard items.

4.13 Additional charges may apply to international deliveries and will be notified pre-despatch in all cases.

4.14 International delivery charges will be specified for all areas serviced upon checkout prior to despatch.

4.15 Bulk orders, tank orders, large lighting, chillers and other large items may be despatched using a dedicated pallet delivery service.

4.16 Please ensure you are able to accept delivery of pallets prior to making your order as specified above.

4.17 Delivery drivers and staff are not obliged to assist any further than placing deliveries onto your premises.

4.18 Delivery drivers and staff are not trained to handle or set-up our products and should not under any circumstances assist with the assembling, programming or usage of any item provided whatsoever.

4.19 We do not accept responsibility in any form for issues arising relating to delivery procedures, these are subject to the terms and conditions of our suppliers.

4.20 Please check all items before accepting delivery. Once an item has been signed-for or accepted we are unable to offer any coverage for items damaged in transit.

4.21 We ensure all items are despatched in the condition specified in the listing and are packed suitably in all cases by our dedicated handling staff.

4.22 We do not offer under any circumstances cover or compensation for consequential losses arising from delivery or transit issues of any sort.

4.23 Our product warranty period begins at first date of attempted delivery by us from which time all risk of loss or damage passes to you.

4.24 You must ensure you provide us with correct delivery address details prior to despatch. Failure to do so may result in items being returned to us. You will be liable for re-delivery charges should this occur in all circumstances.

4.25 All orders processed are subject to current Distance Selling Regulations.

4.26 All applicable UK Mainland orders received before midday GMT will be despatched same day, for next-day courier delivery. All orders received after midday will be despatched the following day. We aim to despatch all items within 24 hours.

4.27 Opening hours Mon-Fri 9am-5pm GMT. No items will be shipped outside of these times. Saturday delivery is available on selected products for an extra fee. Orders must be placed before midday GMT on a Friday to qualify.

4.28 Extended area surcharges may apply to certain overseas locations. We reserve the right to amend delivery charges prior to despatch, and will duly inform the customer. You will be given the rightful option to cancel or proceed with the order in these circumstances.

4.29 No item whatsoever should be accepted or signed for without proper inspection. Doing so will harm your eligibility to claim in the event of damage in transit. Do not sign 'unchecked' for any item as this will also invalidate any claim.

4.30 All palletised deliveries, including aquarium fish tanks, are curb side deliveries only. It is your responsibility to safely bring the item into your home. Drivers are not obliged or insured to assist with the handling or assembling of palletised units. It is advised that sufficient preparation is made to handle larger bulky items before accepting delivery.

 

 

Payment

5.1 The price you pay is the price displayed on this website at the time we receive your order.

5.2 In the unlikely event that we cannot supply goods for whatever reason, you will be informed of this as soon as possible and a full refund will apply if you have already paid for the goods.

5.3 Terms and conditions for payments made by “Paypal” can be found at their website. All Pond Solutions Limited is not responsible for the content of external websites however linked.

5.4 All credit/debit card transactions are accepted at our discretion and accepted under strict confidentiality.

5.5 All transactions may be subject to checks by a registered Credit Reference Agency prior to acceptance. Any checks will only be done to confirm your identity and will not affect your credit rating under any circumstances. All information provided by you will be treated in accordance with the Data Protection Act 1998.

5.6 We take full payment using your selected payment method at time of sale. We do not under any circumstances accept part-payments and are under no obligations to reserve stock for any period due to failed payment.

5.7 All prices are quoted in £ Pound Sterling and include VAT where applicable unless stated otherwise. VAT receipts are available separately upon request and subject to processing times.

 

 

Trade Descriptions, Liability and Additional Requirements

6.1 Every care has been taken to describe and display our products accurately. Variations may occur in both design and specification as the manufacturers upgrade, improve or re-issue their products. We accept no responsibility for minor changes in design subject to these conditions.

6.2 All sizes, dimensions and measurements are approximate and are given as accurately as possible.

6.3 English law applies to all transactions.

6.4 Your statutory rights are not affected by these terms and conditions.

6.5 All completed purchases are deemed as acceptance of these terms and conditions in full.

6.6 No employee of All Pond Solutions Limited is authorised to waive, alter or re-determine our terms and conditions in any way.

6.7 We accept no liability whatsoever for your consequential losses arising from a breach of contract under any circumstances. These also include economic losses, loss of goodwill or reputation, special or indirect losses and all losses incurred as a result of these terms.

6.8 Our total liability for any claim howsoever arising shall not exceed the purchase price of the goods supplied by us to you.

6.9 Third-party claims shall not be entertained under any circumstances whatsoever.

6.10 We are not liable for any specific instructions displayed on our website or in any documentation requested or supplied in relation to or with our products or goods supplied.

6.11 In relation to intellectual property you acknowledge and agree that all copyrights, trademarks and all other intellectual property rights in all materials, products and content made available to you as part of our website shall remain at all times vested in us, our suppliers and our licensors. You are not permitted to copy, use or share any of this material whatsoever unless expressly authorised or permitted in writing by us.

6.12 Any authorised items or images obtained from our website may be used for non-commercial use only. Any other usage of such by you is strictly prohibited and you have no permission whatsoever to pass-on any of our images, material, content or other such intellectual property to any third-party for whatever use under any circumstances. All breaches of said terms will be subject to prosecution where applicable.

6.13 All products are supplied and intended for domestic use only.

6.14 All products supplied are designed and intended for use in ponds and aquarium fish tanks only. They are not intended, designed or supplied for use filtering human or any other form of domestic or commercial waste product, doing so will void all warranty coverage without exception.

6.15 Failure to abide by the terms and conditions outlined here may result in breach of contract.

Faulty Items, Damages or Loss

7.1 Please refer to instructions prior to assembly of any item supplied by us to you. Failure to do so may result in voiding of warranty.

7.2 Photographic proof of damage in transit will be required prior to collections and exchanges being made in all cases.

7.3 Please consult with us prior to returning any faulty item to enable us to attempt to assist before items are returned. Failure to do so may result in voidance of warranty.

7.4 Items returned for repair are subject to variable processing times.

7.5 Any item found to have no fault when tested may be liable for a re-delivery cost.

7.6 Items subject to irreparable operating faults will be replaced or the value of said item will be credited against other products at our discretion and will not exceed the original purchase price paid by you, subject to valid warranty and postage costs.

7.7 We do not cover the life-span of any bulbs that we either sell individually or supply with lighting units or any other associated lighting products, nor indeed any similarly perishable item under our warranty plan.

7.8 All items are subject to a free 12-month warranty unless stated.

7.9 Any warranty offered will cover faulty parts and mechanical operations only.

7.10 All Pond Solutions Limited are not liable under any circumstances for damages occurring to any products, goods or materials supplied once delivery has been accepted in all circumstances.

7.11 Items must be checked for damage in transit and refused at point-of-delivery. Failure to do so will result in your full liability for all damages.

7.12 Any warranty offered will not cover accidental damage or general wear and tear.

7.13 We are not liable for the affect or effect of any of the products we supply (not exceeding standard warranty coverage)

7.14 These terms do not affect your statutory rights.

 

 

Return Policy

8.1 All returns must be packaged adequately and we must be informed of your intention to return items under all circumstances.

8.2 Unwanted items (only) must be returned within 7-days of accepted delivery in the exact condition in which they were despatched. Items returned showing signs of usage will be subject to scrutiny before any form of refund is initiated. Any unwanted item found not to be in good order as supplied will be returned to you at your cost.

8.3 You have the right to return any item, please ensure prior to purchase that the item you have selected is suitable for your needs. All returns will be subject to our scrutiny prior to refund or exchanges being made.

8.4 We reserve the right to offer a consumer credit note to the value of the goods supplied subject to your consumer rights.

8.5 All return postage costs must be covered by you.

8.6 We reserve the right to only accept and process items returned packaged safely and securely.

8.7 Proof of postage is required in all circumstances in relation to returned item disputes.

8.8 It is your responsibility to ensure that a) you obtain proof of postage for each individually returned item b) you package the items securely c) all return postal fees are paid. Failure to do so may result in our inability to process your return.

8.9 All returns must be sent to All Pond Solutions Ltd, Unit 363 Stockley Close, West Drayton, Middlesex, UB7 9BL.

8.10 All applicable pre-order deposits are non-refundable if cancelled after 14 days of original payment date.
