Terms of Business

1. Order can be placed by Post, Phone, Fax, and the Internet.

2. When ordering with 1ST MARTIAL ARTS by Mail order, please send a cheque and write on the back of your cheque your guarantee card number and expiry date.

3. Write clearly your Name, Address, Post Code and Telephone Number and the goods that you require in capital letters. Do not forget to mention the size and the colour you require.

4. Terms are strictly payment with order.

5. All orders will be subject to carriage charges payable in full by the customer.

6. The goods will be dispatched by a reputable carrier, at standard services. Times of delivery are estimated as accurately as possible but can be subject to delays out of our control and therefore we cannot be held responsible.

7. A priority 24 hours service is also available at an additional cost.

8. Cheque payments will have to be cleared through the bank before goods are dispatched. This normally takes 5-7 days.

9. Third party cheques will not be accepted.

10. Customer will be charged £10.00 in the event that any cheque present as payment be returned to our Bankers as unpaid for any reason whatsoever.

11. Any charges incurred from a debt recovery agency will be passed on to the customer.

12. In the case of non-delivery or missing parcels, normally channels will be pursued before replacement or compensation is allowed.

13. Delivery must be checked by customer before signing receipt from carrier. The company will not be responsible for goods damaged in transit if signed for with no reference to condition delivered in.

14. Any damages or shortages must be notified in writing within 1 day of receipt.

15. Signed proof of carrier required where complete parcel is damaged or there are shortage of items.

16. Ownership of goods is only passed to the purchaser when the full payment is received.

17. Where goods are lost, damaged or distorted after delivery, and the ownership has yet to pass, the purchaser will indemnify us against this loss provided which has not resulted from our negligence.

18. Exchange a) A copy of the Invoice should you need to return all / part of the order for size / item exchange, please return it to 1ST MARTIAL ARTS 1A Neptune Road, Harrow Middlesex HA1 4HY. Return carriage will be charged at £4.50 per parcel in UK exchanges. Please enclose the following with the goods. b) Your further Instructions. c) Payment) can be credit card payments, cash or cheque with cheque guarantee card no.

19. No return goods will be accepted unless previously agreed with 1ST MARTIAL ARTS. Return under complaint must indicate invoice number and the 1ST MARTIAL ARTS reference number.

20. Refunds and exchanges can be made for goods that are returned in the original packaging, unworn, unused and unwashed.

21. REFUNDS: Refunds will ONLY be given for damaged goods where no replacement product can be supplied. Abuse/misuse/incorrect ordering by the customer will NOT be refunded. Goods are not available for inspection or on approval basis, 1ST MARTIAL ARTS can take no responsibility for goods incorrectly ordered. If you are unsure of your size, please check our SIZING GUIDE prior to ordering.

22. All other funds will be liable for an administration charge of 10% of the total invoice price.

23. All goods are subject to guarantee against faulty manufacture and defective materials. Goods will be exchanged credited or monies returned only if goods are returned to us in good condition and not suffering from damage due to misuse or excessive wear. This clause does not affect your statutory rights.

24. Weapons can only be sold to persons over the age of 18 years. Use and Misuse of Martial Art Weapons can involve serious risk, including injury, disability and death. Weapons are sold for training and Kata use only under expert supervision! or for demonstration of forms, or as collectors, items for display only, Inspect weapons before use to ensure that they are in perfect condition. DO NOT USE WEAPONS FOR SPARRING OR CONTACT. User assumes all risks of Injury.

25. No wooden weapons used in Martial Arts are under Warranty if used for Contact or sparring.

26. Description and price are correct at the time of going to the press but many are subject to alteration, We reserve the right to invoice at prices ruling at the time of dispatch, Every effort will be made to notify customer of price increase prior to dispatch.

27. Goods are offered subject to availability.

28. We do not accept liability for damage or injury caused through misuse of products purchased.

29. Due to continuous improvement in the Martial Arts World. We reserve the right to alter specifications of products without any notice.

30. All retail and trade prices are inclusive of VAT. Children’s items are zero rated for VAT. VAT is charged at the rate applicable at the time of purchase. Postage and Packing also incurs VAT charges.

31. The actual products may differ from the photographs shown in the catalogue as pictures are for illustration purpose only. These terms supersede all previous business agreements. Sales of Weapons, no weapons will be sold persons under the age of 18 years or to anyone who is not able to supply a M.A.C. license or registered club card. We would like to draw our customers attention to the Prevention of Crime Act 1953 which states that it is prohibited to carry in a public place any weapon considered to be offensive, We would like to point out that holding a license or club card which permits you to purchase weapons does not entitle you to carry such weapons in a public place. Al1 metal Weapons are offered for sale as Collectors and Utility items. There is absolutely no suggestion that any Metal Weapon offered is suitable for combat as a weapon for inflicting injury on a person or causing to fear injury.

Payments

All purchases incl. P&P can be made through PayPal - this is our preferred purchase method.

If you purchase multiple items you will be entitle to a discounted shipping rate. The discounted rate will be dependent upon the item(s) and delivery address/country. To get the discounted delivery charge DO NOT PAY ON CHECKOUT but instead send us a request for an updated invoice with the new price. We will work out the discount and send the updated invoice back to you for payment. If you require more information with multiple purchases please contact us.

Payment is required immediately following the end of the listing (unless you have requested a delivery discount because you have purchased multiple items).
